135-11 June 14, 2011 RESOLUTION WHEREAS, the Township requires the services of labor counsel with regard to various matters including collective bargaining agreements, disciplinary issues, and related matters; and WHEREAS, the Township engaged in a fair and open process pursuant to N.J.S.A. 19:44A-20.4 et seq.; and WHEREAS, by Resolution No. 51-11 adopted March 8, 2011, the Township Council approved the retention of certain counsel including Scarinci Hollenbeck of Lyndhurst, New Jersey; and WHEREAS, the Township's budget issues have necessitated greater negotiations and involvement by labor counsel; and WHEREAS, on April 12, 2011, the Council adopted Resolution No. 82-11 authorizing $15,000 in legal fees and expenses during 2011 for Scarinci Hollenbeck concerning labor and employment matters; and WHEREAS, two unfair labor charges have been filed with the Department of Labor and referred to the Office of Administrative Law concerning certain layoffs which require representation; and WHEREAS, the Township Attorney recommends adoption of a resolution authorizing the Township to increase the allocation for Scarinci Hollenbeck with regard to labor services; and WHEREAS, the Chief Financial Officer of the Township of West Orange has certified the availability of funds in accordance with the "cap" set forth herein; NOW, THEREFORE, BE IT RESOLVED by Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute the annexed agreement to provide legal services between the Township of West Orange and Scarinci Hollenbeck; and it is further RESOLVED, that the "cap" of $15,000 is hereby extended to $30,000 for fees and expenses with regard to the services provided herein; and it is further RESOLVED, that the Municipal Clerk of the Township of West Orange shall cause notice of this award to be published in accordance with applicable law and available for inspection during normal business hours in the office of the Municipal Clerk of the Township of West Orange.
