138-11 June 14, 2011 RESOLUTION AUTHORIZING A “WINDOW” CONTRACT FOR STORM SEWER AND BUILDING RENOVATION 230 & 232 EAGLE ROCK AVENUE Pursuant to N.J.S.A. 19:44A-20.4 et seq. (New Jersey Local Unit Pay-To-Play Laws), the Township must award by resolution all goods and services contracts with a dollar amount between $17,500.00 and $35,999.00. These contracts are not bid, but vendors are still responsible to provide political contribution and company disclosure information in order to do business with the Township. WHEREAS, pursuant to the provisions of N.J.S.A. 19:44A-20.4 et seq., when the cost of goods and/or services that fall between $17,500.00 and the bid threshold of $36,000.00 in the aggregate, an approval by resolution must be in place prior to contract; and WHEREAS, the Township of West Orange Engineering Department proposes to relocate and reroute an existing 30 inch storm sewer on properties 230 and 232 Eagle Rock Avenue; and WHERAS, the required easement for the rerouted storm sewer was acquired from the owners of 230 and 232 Eagle Rock Avenue; and WHEREAS, the Township of West Orange also proposes to renovate and restore an existing residential structure, namely 230 Eagle Rock Avenue, under which the existing 30 inch storm sewer is presently located; and WHEREAS, the existing storm sewer has deteriorated and caused structural damage to a portion of the existing residential structure, specifically the one-car garage area; and WHEREAS, the West Orange Engineering Department retained the services of G. C. Stewart Associates, Inc. of Essex Fells, New Jersey 07021 to prepare site plans for the proposed drainage re-alignment in addition to the related site work; and WHEREAS, Gerhard Huegel, Senior Architect with the West Orange Engineering Department prepared plans for the renovation and restoration of the residential structure; and WHEREAS, a request for quotes for the required work to be performed was requested from several construction contractors; and WHEREAS, the following quotes were submitted to this department: 1. Helios Construction, Inc. $32,630.00 1321A Allenhurst Avenue Ocean, New Jersey 07712 2. Shauger Properties Services, Inc. $41,411.00 429 Dodd Street East Orange, New Jersey 07017 3. S. Lemo Construction LLC $47,300.00 18 East Harvest Avenue

Grabowski Construction, Inc. $51,090.00 770 Northfield Avenue West Orange, New Jersey 07052 WHEREAS, Helios Construction, Inc. has performed work for the Township and is qualified to do this project; and WHEREAS, Helios Construction, Inc. completed and submitted a Business Entity Disclosure Certification which certifies the business entity has not made any reportable contributions to a political or candidate committee in the Township of West Orange in the previous one year, and that the contract will prohibit Helios Construction, Inc. from making any reportable contributions through the term of the contract. NOW THEREFORE, BE IT RESOLVED that the Council of the Township of West Orange authorizes the Purchasing Agent on behalf of the Township to issue and execute a Purchase Order for the foregoing to Helios Construction, Inc. of 1321 Allenhurst Avenue, Ocean, New Jersey 07712 in the amount of $32,630.00 with funds certified available by the Chief financial Officer; and BE IT FURTHER RESOLVED that the Business Administrator is hereby authorized to arrange to pay for the foregoing in accordance with the terms of the purchase order. BE IT FURTHER that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution and notice of this award will be published in accordance with the applicable law.
