1 Public Meeting – August 21, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 17, 2011. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango, and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 7 (Municipal Judge’s Reports), Item 8 (Bills), and Item 12 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the Consent Agenda was implemented. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council went into Executive Session to discuss Matters of Litigation. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council went into their public meeting. All members voting “Aye”. Public Comment The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. Gwen Franklin, 40 Tompkins Street, West Orange Gerry Gurland, 296 Araneo Drive, West Orange and member of the West Orange Historic Preservation Commission. Minutes The Public Minutes of June 26, 2012 were approved as submitted. Report The Municipal Judge’s Reports for the Months of May, June and July, 2012 were approved as submitted. Bills The Bill list was received and ordered paid. A summary of the Bill List is attached. Resolutions : The following Resolutions were adopted: Resolution #161-12 Resolution Authorizing Raffle Applications Resolution #162-12 Resolution Authorizing Escrow Refund for Application ZB-08-32, Block 153.14, Lots 30, 31, 32 &33, 464 Eagle Rock Avenue Resolution #163-12 Resolution Authorizing Discharge of Mortgage for Property Located at 39 Rollinson Street, West Orange Resolution #164-12 Resolution Authorizing a Window Contract for Emergency Sanitary Interceptor Sewer Improvements Rear of Wessman Drive in the Amount Not to Exceed $20,974.33 to Grabowski, 770 Northfield Avenue, West Orange, NJ 07052 Resolution #165-12 Resolution Authorizing Professional Services Contract with Suburban Consulting Engineers, 100 Valley Road, Suite 202, Mt. Arlington, New Jersey 07856 in an Amount Not to Exceed $6,500.00 for Property Located at 55-57 Ridgeway Avenue, West Orange (Funds shall be paid for from the Capital Budget for Design) *It is noted that Deputy Director Leonard Lepore gave a brief overview regarding the above resolution and responded to questions from Council. 3 Resolution Authorizing an Executive Session – Matters of Litigation Ordinance on Second and Final Reading Ordinance #2359-12 Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman Spango, An Ordinance Amending and Supplementing Chapter XXV, Section 25- 30, of the Revised General Ordinances of the Township of West Orange, Entitled Historic Preservation Commission, the ordinance was tabled until the September 11, 2012 Council Meeting. (Planning Board to review prior to final adoption). All members voting “Aye” to table. Ordinance on First Reading Ordinance #2360-12 On motion made by Councilwoman Spango and seconded by Councilman Guarino, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 26.1, BUS STOPS – NORTHFIELD AVENUE EASTBOUND/GREGORY AVENUE, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on September 11, 2012. All members voting “Aye”. Public Hearing on Amendment #1 for 2012 Local Municipal Budget (Resolution #159-12) On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Public Hearing was opened. All members voting “Aye”. Karen J. Carnevale, Municipal Clerk, made the following statement: This is the time for the public hearing on Resolution #159-12, Amendment to 2012 Local Municipal Budget. This amendment was adopted by the governing body on August 13, 2012, was advertised as required by law on August 18, 2012, together with a notice of hearing at this time. The Division of Local Government Services has received a certified copy of the Amendment as in compliance with law. Printed copies have been made available to the public and a supply is here for anyone desiring a copy. Council President Cirilo stated:

4 “Anyone who has not secured a copy of the Amendment may now do so. Before opening this hearing, I wish to outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time. Please address all questions to the chair. Questions must be addressed solely to the Amendment to the Municipal Budget before us. School or County matters are not proper subjects of this hearing and cannot be discussed or answered here tonight. I now declare open the Public Hearing on Resolution #159-12. Council President Cirilo asked if anyone wished to be heard on the Budget Amendment. Clare Silvestri, 20 Grand View Avenue, West Orange Rosary Morelli, 22 Ralph Road, West Orange Sean Smith, 14 Hillcrest Avenue, West Orange Chief James P. Abbott, West Orange Police Department Mayor Parisi gave an overview on the Amendment to the 2012 Local Municipal Budget. There was no one else who wished to be heard at this time. On motion made by Councilwoman McCartney and seconded by Councilman Krakoviak, the public hearing was closed. All members voting “Aye”. On motion made Councilman Guarino and seconded by Councilwoman McCartney, the Council adjourned their public meeting and reconvened as the Alcoholic Beverage Control Board. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango, and Council President Cirilo voting “Aye”. Councilman Krakoviak was not present at the time of voting. ABC HEARING 490-12 Person to Person Transfer from Krish Liquors to Central Liquors, LLC The appropriate fees have been paid and the affidavit of publication placed on file. Mahesh Rajan, Esq., attorney for the buyer, was present. Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Guarino , the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango, and Council President Cirilo voting “Aye”. Councilman Krakoviak was not present at the time of voting. All members voting “Aye”. 5 Resolution to Adopt the 2012 Local Municipal Budget Following discussion and on motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango, and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Minutes of this meeting are on file in the Office of the Municipal Clerk. On motion made by Councilwoman Spango and seconded by Councilman Guarino, the meeting was adjourned at 9:32 P.M. KAREN J.
