1 Public Meeting – October 16, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 17, 2011. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango, and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. John Schmidt, 27 Glen Avenue, West Orange E. Michael Taylor, Watchung Avenue, West Orange Rosary Morelli, 22 Ralph Road, West Orange Paula Taylor, Watchung Avenue, West Orange Earl Turner, Mt. Pleasant Avenue, West Orange There was no one else who wished to be heard and the public hearing was closed.

2 Minutes The Executive Session Minutes of October 2, 2012 were approved as submitted. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. *It is noted that Councilman Krakoviak abstained on the above. Resolutions The following resolutions were adopted: Resolution #191-12 Resolution Authorizing the Township of West Orange to Submit the Best Practices Inventory to the Division of Local Government Services Resolution #193-12 Resolution Authorizing a Subordination of Mortgage for Block 153.04, Lot 3, 21 Robertson Road Resolution #194-12 Resolution Authorizing Raffle Licenses Resolution #195-12 Removed (Duplicate) Resolution #196-12 Resolution Authorizing a Hold Harmless and Indemnification Agreement Between the Township of West Orange and the Township of Livingston for Use of the Livingston Pistol Range for the Purposes of Firearms Training Resolution #197-12 Resolution Authorizing the Execution of a Revised Stipulation of Settlement with Conquest Industries, LLC in Connection with the Downtown West Orange Streetscape and Traffic Improvement Program Ordinances on Second and Final Reading Ordinance #2362-12 On motion made by Councilman Guarino and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN

3 TOWNSHIP OF WEST ORANGE MUNICIPAL EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEES STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL, was taken up on second and final reading. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the schedule time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Business Administrator Jack Sayers commented on the above ordinance and responded to questions from Council. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Ordinances on First Reading Ordinance #2363-12 On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, BOND ORDINANCE AMENDING BOND ORDINANCE 1374-96 FINALLY ADOPTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY ON FEBRUARY 9, 1996, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on October 30, 2012. All members voting “Aye”.

4 Resolution #192-12 Resolution Authorizing the Acceptance of the Award from the U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA) of the Staffing for Adequate Fire and Emergency Response (SAFER) Grant in the Amount of $1,775,610.00 Chief Peter Smeraldo, West Orange Fire Department commented on the above resolution and responded to questions from Council. Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. The Minutes of this meeting are on file in the Office of the Municipal Clerk. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the meeting was adjourned at 9:35 P.M.
