1 Public Meeting – March 19, 2013 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale , Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 29, 2012. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Councilwoman Spango Absent: Council President Cirilo Due to Council President Cirilo’s absence, a motion was made by Councilwoman Spango and seconded by Councilman Guarino, to appoint Councilwoman McCartney, the Council’s most senior member as acting Council President for the evening. All members present voting “Aye”. General Matters A motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, to use the Council’s investigation/inquiry powers to further research the process for the position of the Executive Director of the Downtown West Orange Alliance, was not carried. Councilman Krakoviak and Councilwoman McCartney voting “Aye”. Councilman Guarino and Councilwoman Spango voting “Nay”. The vote 2-2, failed. The Township Council identified and presented for unanimous consent, Item 7 (Report), Item 8 (Bills), and Item 9 (Certain Resolutions). All members present voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time: Mark Meyerowitz, 19 Howell Drive, West Orange Robert Dryer, Kinzel Lane, West Orange Athia Tweiten, 16 Edgar Road, West Orange
2 Elissa DiPano, 95 Harrison Avenue, West Orange Rosary Morelli, 22 Ralph Road, West Orange Christine Bosco, 4 Masson Place, West Orange Anthony Puglisi, Public Information Officer for Essex County Jessica Glicker, Public Information Officer, West Orange There was no one else who wished to be heard and the public hearing was closed. Report The Municipal Judge’s Report for the Month of February, 2013 was received and placed on file. Bills The Bill List was received and ordered paid. A summary of the Bill List is attached. 3 Resolution #56-13 Authorization to Calculate the Township’s Tax Collection Rate by Taking Into Account 2012 Tax Appeals and Provide Property Tax Payers the Tax Relief Benefit Offered by N.J.S.A. 40A:4-41(C)(2) Resolution #57-13 Resolution to Introduce the 2013 Local Municipal Budget Resolution #58-13 Resolution Authorizing Assignment of Tax Sale Certificates for Block 152.28, Lot 126, Henry Street, West Orange, Block 159.08, Lot 51.02 – 399 Northfield Avenue, West Orange, Block 177.08, Lot 21-691 Eagle Rock Avenue, West Orange Resolution #59-13 Resolution Authorizing a Subordination of Mortgage for Block 139, Lot 61 and 62, 39 Franklin Avenue, West Orange Resolution #62-13 Resolution Authorizing the Renewal of the Interlocal Agreement with the Borough of Roseland for Animal Control Services Resolution #63-13 Resolution Authorizing an Appropriation Transfer Pursuant to N.J.S.A. 40A:4-58 Resolution #64-13 Resolution Authorizing an Executive Session to Discuss a Matter of Litigation Ordinances on Second and Final Reading Ordinance #2370-13 On motion made by Councilman Guarino and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE MUNICIPAL EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF CIVIL SERVICE – COAH COORDINATOR, MUNICIPAL ALLIANCE COORDINATOR, was taken up on second and final reading.
4 All members present voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye”. Ordinance #2371-13 On motion made by Councilman Guarino and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 19, SECTION 10 OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE “ENTITLED “ANNUAL SEWER CHARGES”, was taken up on second and final reading. All members present voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Christine Bosco, 4 Masson Place, West Orange commented on the above mentioned ordinance. John O. Gross, Chief Financial Officer, gave a brief overview of the above ordinance and responded to questions from Council. There was no one else who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye”.
5 Ordinance on First Reading Ordinance #2372-13 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – 56 LLEWELLYN AVENUE, was introduced and approved on first reading. All members present voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on April 9, 2013. All members present voting “Aye”. Resolution #60-13 Resolution Authorizing the Mayor to Execute the License Agreement for the Use of Oskar Schindler Performing Arts Center (OSPAC) Including the Mandated Sublicense Agreement and the Rules and Regulations Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney and Councilwoman Spango voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #61-13 Resolution Authorizing Settlement of Litigation Entitled NJ DEP, et al v. Occidental Chemical Corporation, et. al. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members present voting “Aye”. ABC HEARING Resolution #495-13 Resolution Authorizing a Renewal for 2012-2013 License Term for ARA Kitchen, LLC, 0722-33-037-006 (Pocket)
6 The above mentioned resolution was pulled from the consent agenda. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the meeting was adjourned at 10:15 P.M.
