1 Public Meeting- April 9, 2013 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 29, 2012. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Councilwoman Spango and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilman Guarino and seconded by Councilwoman Spango, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time: Bert Peronilla, Pleasant Valley Way, West Orange Pastor Douglas Adams, 9 Westover Terrace, West Orange John Schmidt, 27 Glen , Llewellyn Park, West Orange Elissa DiPano, Board Member, West Orange Downtown Alliance Earl Turner, Mt. 2 Mark Meyerowitz, 19 Howell Drive, West Orange Tony Spina, Maple Street, West Orange Anthony Puglisi, Essex County Public Information Officer Kevin Kruse, 28 Harriet Street, West Orange Jerry Eben, Walker Road, West Orange Chief Peter Smeraldo, West Orange Fire Department There was no one else who wished to be heard and the public hearing was closed. Resolutions The following Resolutions were adopted: Resolution #65-13 Resolution Authorizing Raffle Licenses Resolution #66-13 Resolution Authorizing Reimbursement Costs for Private Garbage Collection for the Period of January 1, 2012 through December 31, 2012 to Private Home Owner Associations/Individuals Resolution #68-13 Resolution Authorizing the Township to Obtain Payment from the Insurance Company of the User of Ambulance Transport Services Provided by the West Orange Fire Department or other West Orange Emergency Management Services Resolution #70-13 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey Resolution #71-13 Resolution Authorizing the Collector of Taxes to Refund Duplicate Payment of Taxes to Corelogic, Forth Worth, Texas in the Amount of $606.03 Resolution #72-13 Resolution Authorizing a Memordandum of Agreement between the Township of West Orange and Teamster Local 560 from January 1, 2010 to December 31, 2013
3 Resolution #73-13 Resolution Authorizing Competitive Contracting for Payroll Processing Services Resolution #74-13 Resolution Authorizing Competitive Contracting for Emergency Transport Third Party Billing Services Ordinance on Second and Final Reading Ordinance #2372-13 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – 56 LLEWELLYN AVENUE, was taken up on second and final reading. Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Councilwoman Spango voting “Aye”. Council President Cirilo abstained. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading, ordered advertised according to law, to come up for second and final reading on April 23, 2013. Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Councilwoman Spango voting “Aye”. Council President Cirilo abstained on the above. Ordinance on First Reading Ordinance#2373-13 AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFCATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF CIVIL SERVICE , was introduced and approved on first reading.
4 All members present voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on April 23, 2013. All members present voting “Aye”. Resolution #67-13 Resolution Approving the Certification List for LOSAP for the Year 2012 On motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #69-13 Resolution Supporting PSE&G’s “Energy Strong” Program Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was tabled. Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, and Council President Cirilo voting “Aye” to table. Councilwoman Spango voting “Nay”. ABC HEARING On motion made by Councilwoman McCartney and seconded by Councilman Krakoviak, the Council reconvened as the ABC Board. All members voting “Aye”. Resolution #495-13 Resolution Authorizing a Renewal for 2012-2013 License Term for ARA Kitchen, LLC 0722-33-037-006 (Pocket) Following discussion and on motion made by Councilman Guarino and seconded by Councilman Krakoviak, the above mentioned resolution was adopted. All members voting “Aye”.
5 Resolution #496-13 Resolution Authorizing the Renewal for 2012-2013 License Term for ABC License 0722-44-061-008 held by Shaku & Kamil, Inc. c/o Keval T. Patel, 429 Hidden Valley Drive, Edison, NJ Following discussion and on motion made by Councilman Guarino and seconded by Councilman Krakoviak, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the Council adjourned as the ABC Board and reconvened as Council. All members voting “Aye”. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the meeting was adjourned at 10:30 P.M. All members voting “Aye”. KAREN J.
