1 Public Meeting – April 23, 2013 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meeting Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 29, 2012. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 6 (Communication), Item 7 (Report), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilman Guarino and seconded by Councilwoman Spango, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time: John Schmidt, 27 Glen, Llewellyn Park, West Orange John Blanton, Forest Hill Road, West Orange Rodolfo Rodriguez, 22 Ashwood Terrace, West Orange Mark Meyerowitz, 19 Howell Drive, West Orange George Gantor, 4 Fernwood Circle, West Orange Christine Bosco, 4 Masson Place, West Orange There was no one else who wished to be heard and the public hearing was closed.
2 Minutes The Public Minutes of April 9, 2013 were approved as submitted. Report The Municipal Judge’s Report for the Month of March, 2013 was received and placed on file. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #75-13 Resolution Appointing Fire Captain Matthew Longo as Municipal Fire Official for a Three (3) Year Term Effective May 1, 2013 and Expiring on April 30, 2015 Resolution #77-13 Resolution Authorizing a Contract with Garden State Laboratories, Inc. for Public Health Testing Services for a One Year Period Beginning January 1, 2013 and Ending December 31, 2013 at a Cost of $5,000 Resolution #79-13 Resolution Authorizing Subordination of Mortgage – 27 McKinley Avenue Resolution #80-13 Resolution Authorizing Raffle Licenses Resolution #81-13 Resolution Authorizing Award of Contract to Grabowski Construction, Inc., 770 Northfield Avenue, West Orange, NJ for the Nicholas Avenue Extension in the Amount of $127,115.00 Resolution #83-13 Resolution Authorizing an Addendum to the Shared Services Agreement between the Township of West Orange and the Board of Education for the Lincoln Field Playing Surface Project PULLED Resolution #85-13
3 Resolution Authorizing an Additional Appropriation of $94,000 for Professional Construction Phase Services Associated with the Mayfair District Storm Sewer Improvements, Contract No. 3B provided by PS&S, 67B Mountain Boulevard Extension, P.O. Box 4039, Warren, NJ 07059, in accordance with amended proposal dated April 12, 2013 Resolution #86-13 Resolution Authorizing a Helicopter Landing by Sky River Helicopters, LLC, Bernardsville, NJ at the Montclair Country Club for the Purpose of the Anthony Fasano Foundation Golf Outing on May 6, 2013. Ordinances on Second and Final Reading Ordinance #2373-13 On motion made by Councilwoman McCartney and seconded by Councilman Guarino, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NJ DEPARTMENT OF CIVIL SERVICE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinances on First Reading Ordinance #2374-13 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-23.3, U-TURN PROHIBITIONS, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE , was introduced and passed on first reading. The Clerk read the ordinance by title only.
4 Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was passed on first reading, ordered advertised according to law, to come up for second and final reading on April 23, 2013. All members voting “Aye”. Resolution #76-13 Resolution to Read the 2013 Municipal Budget by Title Only Public Hearing on 2013 Local Municipal Budget On motion made by Councilwoman Spango and seconded by Councilman Guarino, the public hearing on the 2013 Local Municipal Budget was opened. All members voting “Aye”. The Clerk stated that this was the scheduled time for the public hearing on the Local Municipal Budget for 2013 which was introduced on March 19, 2013 and was advertised in full as required by law, on April 4, 2013, together with a notice of hearing for this time. “Printed copies of the budget have been made available to the public and a supply is here for anyone desiring a copy.” Council President Cirilo stated “Anyone who has secured a copy of the budget may now do so.” Before opening the hearing, I wish to outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time, in order of rising, as nearly as I can determine. Would anyone like to be heard?”. Christine Bosco, 4 Masson Place, West Orange Marial Clemenson, 4 Cherrywood Circle Rosary Morelli, 22 Ralph Road, West Orange There was no one else who wished to be heard at this time. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Resolution Regarding the Reading of the 2013 Local Municipal Budget was adopted. Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the public hearing on the 2013 Local Municipal Budget was closed. All members voting “Aye” as the roll was called.
5 TABLED Resolution 69-13 Resolution Supporting PSE&G’s “Energy Strong” Program Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution tabled. Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Council President Cirilo voting “Aye” to table. Councilwoman Spango voting “Nay” to table. Resolution #78-13 Resolution Authorizing a Seventh Amendment to the Agreement with the NJ Medical School Global Tuberculosis Institute at UMDNJ for the Period Between January 1, 2013 and December 31, 2013 at the Rate of $4,752 for TB Services Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #82-13 Resolution Authorizing an Award of Contract to Replace the Artificial Turf Surface at Lincoln Field to FieldTurf, USA, Inc., 8088 Montview Road, Montreal Quebec, Canada in the Amount of $416,955.05 Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #84-13 Resolution Authorizing Change Order No. 1 to Amend Contract with Packetalk in the Amount of $35,515.00 for Four (4) Additional Security Surveillance Cameras with Installation Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”.
6 The Minutes of this meeting are on file in the Office of the Municipal Clerk. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the meeting was adjourned at 10:16 p.m. .
