1 Public Meeting – June 11, 2013 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 29, 2012. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 7 (Report), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. 2 There was no one else who wished to be heard and the public hearing was closed. Minutes The Public Minutes of May 21, 2013 were approved as submitted. Report The Municipal Judge’s Reports for the Months of April, 2013 and May, 2013 were received and placed on file. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #113-13 Resolution Authorizing Issuance of Raffle Licenses Resolution #114-13 Resolution Reappointing JoAnn Behar as Deputy Township Clerk for a Term of 2 Years – July 1, 2013 – June 30, 2015 Resolution #115-13 Resolution Authorizing the Memorandum of Agreement Between the Township of West Orange and the National Ovarian Cancer Coalition for the Downtown Class 5K Run on September 29, 2013. Resolution #116-13 Resolution Appointing Peter F. Smeraldo, Jr., Fire Chief as Municipal Emergency Management Coordinator for a Three Year Term Expiring on June 15, 2016 Resolution #117-13 Resolution Authorizing the Payment of $1,026 (Township’s Portion) to Barbara Weisman, Esq. for Mediation Expenses in the Matter of Sadlon, et al. vs. The Pointe, et al.

3 Resolution #118-13 Resolution Awarding a Grant to the Daughters of Israel Geriatric Services, Inc., Jewish Federation Plaza, 748 -750 Northfield Avenue from the West Orange Emergency Repairs Program Resolution #119-13 Resolution Approving the Emergency Repairs/Energy Efficiency Program Operating Manual Establishing Rules for the Operation of the Program Resolution #123-13 Resolution to Award a Contract to PSE&G to Install Site Lighting in the New Ridgeway Park Consisting of 6 Post Lamps and 16 Bollard Lights for A Fee of $45,364.42 Resolution #124-13 Resolution Authorizing the Sale of Abandoned Cars to Be Sold at Auction Resolution #125-13 Resolution Authorizing an Award of Contract to Mike Shannon Sports, 1010 Edgehill Terrace, Whippany, NJ in the Amount NTE $30,000 Ordinance on Second and Final Reading Ordinance #2377-13 On motion made by Councilwoman Spango and seconded by Councilman Guarino, BOND ORDINANCE AMENDING BOND ORDINANCE 2366-13 FINALLY ADOPTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY ON DECEMBER 18, 2012, was taken up on second and final reading. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law.

Ordinances on First Reading - None Resolution #120-13 Resolution Awarding a Contract to Quality Electrical Construction Co., 290 Laurel Avenue, West Keansburg, NJ 07734 for the Installation of Equipment Supplied by the Township to Maintain a 50 Footcandle Lighting Level at the WOHS Joseph Suriano Track and Field Following discussion and on motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #121-13 Resolution Authorizing the Township to Purchase Lighting Equipment from Musco Sports Lighting, LLC, Oskaloosa, IA at a Cost of $146,734.00 Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #122-13 Resolution to Award a Contract to Scalora Brothers, Inc., t/a Scalora Landscaping, 382 Lackawanna Plaza, S. Orange, NJ in the Amount of $406,481.00 for Base Bid, Alternate No. 3 and Alternate No. 4 for Ridgeway park Site and Landscape Improvements Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned resolution was adopted. 5 Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned resolution was tabled. All members voting “Aye” to table. Resolution #127-13 Resolution Authorizing an Award of State Contract #70256/WN88AZ and Dell Marketing WSCA/NASPO Contract #B7160 for IT Network Upgrades in an Amount NTE $125,000 Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. ABC HEARING On motion made by Council President Cirilo and seconded by Councilman Krakoviak, the Council adjourned and went into the hearing as the Alcoholic Beverage Control Board. All members voting “Aye”. Resolution #497-13 Renewal of Plenary Retail Distribution, Consumption and Club License for the 2013-2014 License Term On motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #498-13 Hearing on Renewal for the 2013-2014 License Term – Huguitos (Special Conditions) On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #499-13 Hearing on Renewal for 2013-2014 License Term – AMC Entertainment International (Special Conditions)

Resolution #501-13 Hearing on Renewal for 2013-2014 License Term –DJF, 4SIXTY6 (Special Conditions) On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #502-13 Hearing on Renewal for 2013-2014 License Term – Suzy Que’s, LLC (Special Conditions) On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council adjourned from the ABC Hearing and returned as the Township Council. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman Spango, the meeting was adjourned at 10:00 p.m. All members voting “Aye”.
