1 Public Meeting – May 6, 2014 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 7:30 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 22, 2013. Roll Call: Present: Councilman Cirilo, Councilman Guarino, Councilman Krakoviak, Councilwoman Spango and Council President McCartney Absent: None The Township Council identified and presented by unanimous consent, Item 5 (Minutes), Item 6 (Reports), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilman Cirilo and seconded by Councilwoman Spango, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Clare Silvestri, 20 Grand View Avenue, West Orange George Stafford, New Jersey Highlands Coalition Earl Turner, Mount Pleasant Avenue, West Orange Melissa Evans, 8 North Koewing Place, West Orange Rosary Morelli, 22 Ralph Road, West Orange Mark Meyerowitz, 19 Howell Drive, West Orange Anthony Puglisi, Public Information Officer, Essex County There was no one else who wished to be heard and the public hearing was closed.
2 Minutes The Minutes of April 22, 2014 were approved as submitted. Report The Municipal Judge’s Reports for the Month(s) of February 2014 and March 2014 were received and placed on file. Bills The Bill List was received and ordered paid. A summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #82-14 Resolution Authorizing Raffle Licenses Resolution #83-14 Resolution Authorizing Self Examination of the Municipal Budget Resolution #85-14 Resolution Authorizing an Executive Session to Discuss Litigation – Township of West Orange v. Link Communications, Ltd. Resolution #88-14 Resolution to Award Bid for Pool Concession Stand 2014 Season to Verona Bagels & Deli, LLC t/a Baglewich Bagel Bakery for $6,500 Resolution #89-14 Resolution to Authorize Abandoned Car Sale at Twin Towing, Inc. and Select Towing Service, Inc. on May 20, 2014 Resolution #90-14 Resolution to Read Budget by Title Only
3 Ordinances on Second and Final Reading Ordinance #2407-14 On motion made by Councilwoman Spango and seconded by Councilman Guarino, BOND ORDINANCE AUTHORIZING VARIOUS CAPITAL IMPROVEMENTS IN AND FOR THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY, APPROPRIATING $6,999,638 THEREFORE AND AUTHORIZING THE ISSUANCE OF $6,649,656.00 BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF, was taken up on second and final reading. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. On motion made by Council President McCartney and seconded by Councilman Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. Ordinance #2408-14 On motion made by Councilman Guarino and seconded by Councilman Cirilo, BOND ORDINANCE AUTHORIZING REPLACEMENT OF BLEACHERS AT VARIOUS FIELD AT THE HIGH SCHOOL IN AND FOR THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY, APPROPRIATING $60,000 THEREFORE AND AUTHORIZING THE ISSUANCE OF $57,000 BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF, was taken up on second and final reading.

Ordinance #2409-14 On motion made by Councilman Guarino and seconded by Councilwoman Spango, BOND ORDINANCE AMENDING BOND ORDINANCE NUMBER 2358-12 FINALLY ADOPTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY ON JUNE 12, 2012, was taken up on second and final reading. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Council President McCartney and seconded by Councilman Cirilo, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. 5 Resolution #91-14 Resolution to Amend 2014 Municipal Budget #2 Following discussion and on motion made by Council President McCartney and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #84-14 Resolution to Adopt the 2014 Municipal Budget Public Hearing on 2014 Local Municipal Budget On motion made by Councilman Guarino and seconded by Councilwoman Spango, the public hearing on the 2014 Local Municipal Budget was opened. All members voting “Aye”. The Clerk stated that this was the scheduled time for the public hearing on the Local Municipal Budget for 2014 which was introduced on April 8, 2014 and was advertised in full as required by law, on April 17, 2014, together with a notice of hearing for this time. “Printed copies of the budget have been made available to the public and a supply is here for anyone desiring a copy.” Council President McCartney stated “Anyone who has not secured a copy of the budget may now do so.” Before opening the hearing, I wish to outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time, in order of rising, as nearly as I can determine. Would anyone like to be heard?” Mariel C. On motion made by Council President McCartney and seconded by Councilwoman Spango, the Resolution to Adopt the 2014 Local Municipal Budget was approved.
6 Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. On motion made by Council President McCartney and seconded by Councilman Guarino, the Council went into Executive Session to discuss a matter of litigation. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman Spango, the Council returned from Executive Session into the public meeting. All members voting “Aye”. Resolution #86-14 Resolution Authorizing Execution of Settlement Agreement to Resolve Litigation Regarding Link Communications, Ltd. On motion made by Council President McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #87-14 Resolution Authorizing a Special Emergency Appropriation Following discussion and on motion made by Council President McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. ABC HEARING On motion made by Council President McCartney and seconded by Councilman Guarino, the Council adjourned at the Township Council and reconvened as the ABC Board. All members voting “Aye”. Resolution #514-14 Person to Person/Place to Place Transfer of Plenary Retail Consumption License No. 0722-33-048-010, Landrose Ltd. (Inactive) which will be located at 350 Pleasant Valley Way, West Orange (Wilshire)
7 On motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #515-14 Place to Place Transfer of Plenary Retail Distribution License No. 0722-44- 011-007, Central Liquors LLC (Inactive) which will be located at 2 Central Avenue, West Orange (Krauszer’s) On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #516-14 Place to Place Transfer/Expansion of Premises, Plenary Retail Distribution License No. 0722-44-046-008, Total Wine & More, 495 Prospect Avenue, Suite 325, Essex Green Shopping Center On motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the Council adjourned as the ABC Board and reconvened as the Township Council. All members voting “Aye”. On motion made by Council President McCartney and seconded by Councilman Guarino, the meeting was adjourned at 11:55 P.M. All members voting “Aye”.
