1 Public Meeting – January 27, 2015 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 7:10 p.m. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 4, 2014. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Guarino Absent: None The Township identified and presented for unanimous consent, Item 4 (Minutes), Item 5 (Report) and Item 8 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members voting “Aye” Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Annelies Richmond, Hutton Gardens, West Orange There was no one else who wished to be heard and the public hearing was closed. Minutes The Public Minutes of December 9, 2014 and January 6, 2015 were approved as submitted. Report The Municipal Judge’s Reports for the Months of October, November and December were received and placed on file. Resolutions: The following resolutions were adopted on Consent: Resolution #37-15 Resolution Authorizing Raffle Licenses Resolution #38-15 Resolution Authorizing the Township to Apply for the 2015 New Jersey Historic Preservation Sub-Grant (for CLG-Certified Local Grant) in an Amount of Not Less Than $9,000 and Not More than $24,999 (memorialized)

Matthews) as Special Tax Counsel for the Provision of Commercial Real Estate Tax Appeal Services on a Flat Fee Basis of $3,250 Per Month for the Balance of Calendar Year 2015 Ordinances on Second and Final Reading Ordinance #2437-15 On motion made by Councilman Cirilo and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-11, PARKING TIME LIMITED ON CERTAIN STREETS DURING CERTAIN HOURS; SUBSECTION 7-23.1, TURN PROHIBITIONS AND SUBSECTION 7-26.1, BUS STOPS OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – ST. CLOUD AVENUE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Council President Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2438-15 On motion made by Councilwoman McCartney and seconded by Council President Guarino, AN ORDINANCE AMENDING AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEE SETTING FORTH THEIR TITLES, CLASSIFICATIONS AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL-COMMUNICATIONS MANAGER, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. 4 AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATIONS AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL – COMMUNICATIONS MANAGER, was introduced and passed on first reading. The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on February 10, 2015. All members voting “Aye”. Ordinance #2440-15 REFUNDING BOND ORDINANCE PROVIDING FOR THE REFUNDING OF EMERGENCY APPROPRIATIONS RELATED TO PAYMENT OF AMOUNTS OWING TO OTHERS FOR TAXES LEVIED IN AND BY THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY, APPROPRIATING $2,284,702 THEREFOR AND AUTHORIZING THE ISSUANCE OF $2,284,702 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING THE COST THEREOF, was introduced and passed on first reading. The Clerk read the ordinance by title only. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on February 10, 2015. Resolution #44-15 Resolution to Award a Professional Services Contract to Matrix New World, 26 Columbia Turnpike, Florham Park, New Jersey to Provide Professional Environmental Services of a Licensed Site Remediation Professional to Further Investigate Those Sites Where Underground Storage Tanks were Removed in Accordance with Their Proposal dated December 3, 2014 for an Amount NTE $83,270.00 Following discussion and on motion made by Councilwoman Spango and seconded by Council President Guarino, the above mentioned resolution was adopted. 5 Council President Guarino asked if any member of the public wished to be heard. There were no comments. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the Downtown West Orange Budget for the Year 2015 was adopted. Councilman Cirilo, Councilwoman McCartney, Councilwoman Spango and Council President Guarino voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #51-15 Resolution Authorizing an Emergency Contract between the Township and Rapid Pump and Meter Service Co., Inc. of P.O. Box AY, 285 Straight Street, Paterson, New Jersey 07509 for Emergency Improvements at the Northfield Avenue Pump Station in the Amount of $52.831.64 to Replace Leaking Pipes and Valves that were Flooding the Pumps in the Station Jeopardizing Public Health, Safety and Welfare is Approved Pursuant to NJSA 40A:11-6 and NJAC 5:34-6.1 Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Cirilo, the above mentioned resolution was adopted. Councilman Cirilo, Councilwoman McCartney, Councilwoman Spango and Council President Guarino voting “Aye”. Councilman Krakoviak voting “Nay”. ABC HEARING Resolution #533-15 Person to Person and Place to Place Transfer from 47 Chestnut LLC to WL West Orange, LLC t/a Wine Legend, License No. 0722-32-019-004 On motion made by Council President Guarino and seconded by Councilwoman Spango, the Council adjourned as the Township Council and reconvened as the ABC Board. All members voting “Aye”. All the requirements have been met for the above license transfer. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned ABC Resolution was adopted. All members voting “Aye”. On motion made by Council President Guarino and seconded by Councilwoman McCartney, the Council adjourned as the ABC Board and returned as the Township Council. All members voting “Aye”. On motion made by Council President Guarino and seconded by Councilman Cirilo, the meeting was adjourned at 8:44 p.m.
