1 Conference Meeting – January 5, 2016 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, and 66 Main Street, West Orange, New Jersey at 6:37 p.m. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Public Law, 1975. A notice of this meeting was emailed to the Star Ledger and the West Orange Chronicle on October 14, 2015. Roll Call: Present: Councilwoman Casalino, Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Council President Cirilo Council President Cirilo took his Oath of Office publicly. The official oath took place on January 1, 2016 at 12 noon. Councilman Guarino presented a gavel to Council President Cirilo in recognition of his role as Council President. During Council Liaison announcements, the Council members acknowledged the devastating New Year’s Day fire at St. Mark’s Church. 3 n. 15-16 Resolution Authorizing Change Order No. 1 and Final Between Granada Construction Corporation, 147 Thomas Street, Newark, NJ for the Project 2015 Road Improvements, Phase I Various Streets; High Street, Orange Place for a 2.57 Percent Decrease in the Amount of $17,518.99 (Lepore) o. 16-16 Resolution Supporting the Use of a “No Passing Zone” on Route 10, West Orange as Recommended by the NJ DOT (Lepore) On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the consent agenda was approved. All members voting “Aye.” Resolution(s) Removed from Consent Agenda j. 10-16 Resolution Authorizing Execution of Veterinary Supervision Services Agreement This resolution would authorize the execution of a two-year agreement with Dr. Robert DeFillippis, D.V.M., to provide veterinary supervision services for the Township in accordance with the terms and conditions set forth in the annexed agreement. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. Councilwoman Casalino, Councilwoman McCartney, Councilman Guarino and Council President Cirilo voting “Aye.” Councilman Krakoviak voting “Nay.” p. 17-16 Resolution Authorizing Change Order Oxford Terrace, Winding Way & Dartmouth Road Roadway Improvements Change Order No. 2 (Lepore) On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. Councilwoman Casalino, Councilwoman McCartney, Councilman Guarino and Council President Cirilo voting “Aye.” Councilman Krakoviak voting “Nay.” Ordinance(s) on First Reading a. 2472-16 An Ordinance Amending and Supplementing Chapter X of the Revised General Ordinances of the Township of West Orange, Entitled “Animals”, Adding Section 10-15, Et Seq. to Permit the Managed Care of Feral Cats (Legal-Kayser) A motion was made by Councilman Guarino and seconded by Councilwoman McCartney to introduce the above mentioned ordinance on first reading. Township Clerk Carnevale asked if the ordinance should be discussed prior to introduction. The Council agreed that they wished to have a discussion first. Councilman Guarino and Councilwoman McCartney rescinded their motion to introduce the ordinance and a discussion ensued. Judy Stier and Theresa DeNova, Health Officer, W.O. Township participated in the discussion with Council. During the

During the discussion, Councilwoman Casalino made a motion to amend Section 10-15.4 (c) to provide for the notification to neighbors of a TNR caregiver in their neighborhood. The motion was seconded by Councilman Krakoviak. Councilwoman Casalino and Councilman Krakoviak voting “Aye.” Councilman Guarino, Councilwoman McCartney and Council President Cirilo voted “Nay.”

4 The motion failed. On motion made by Councilwoman McCartney and seconded by Council President Cirilo, the Council agreed to amend the language in Section 10-15.5 ( e ) with regard to the hours the food for the feral cats can be left outside. On motion made by Councilman Guarino and seconded by Council President Cirilo, the above mentioned amended ordinance was approved on first reading, ordered advertised according to law, to come up for second and final reading on February 9, 2016. Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Council President Cirilo voting “Aye.” Councilwoman Casalino abstained. ABC Hearing On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council entered into a hearing as the ABC Board. All members voting “Aye.” a. 554-16 Hearing on Renewal for Plenary Retail Consumption, Distribution and Club Licenses for the 2015-2016 License Term Renewal – License No. 0722-33-063-004 – Cecelia Grabowski (Inactive/Pocket) On motion made by Councilwoman Casalino and seconded by Councilman Cirilo, the Council approved the above referenced ABC resolution. All members voting “Aye.” On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council adjourned as the ABC Board and returned to their public meeting as Township Council. All members voting “Aye.” At 9:59 p.m., on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council meeting was adjourned. All members voting “Aye”.
