MINUTES TOWNSHIP OF WEST ORANGE ZONING BOARD OF ADJUSTMENT REGULAR MEETING March 17, 2016 Chairman Neuer called the West Orange Zoning Board of Adjustment meeting to order at approximately 8:00 pm. Chairman Neuer stated that the record will reflect that there were no other Board Members present other than himself. Chairman Neuer stated that also present were Alice Beirne, Board Attorney, Rose DeSena, Board Secretary, a West Orange Police Officer, Robert Williams, Esq. and Eve Rappaport, Paralegal. Chairman Neuer stated for the record that they do not have a quorum; no business will be conducted and no formal actions will be taken. Chairman Neuer said that there also appears to have been an issue as to whether notice of this meeting was proper under the Open Public Meetings Act and for that reason, as well, following a few announcements the meeting will be adjourned. Chairman Neuer stated that the schedule of Regular Zoning Board meetings have now been properly published and there will not be any further issues regarding proper notice under the Open Public Meetings Act. Chairman Neuer stated that there were no members of the public present. The two applications, Sai Hira Ram Trust, Inc. and Prism Green Associates that were scheduled to be heard at this meeting will be carried over to the regular Zoning Board meeting to be held on April 21, 2016 and that no further notice will be necessary. Chairman Neuer announced that Doug Chabrak, a member of the public, entered the room. He informed Mr. Chabrak that the Board will not be transacting any business because of an issue raised regarding notice of the meeting. Chairman Neuer also informed Mr. Chabrak that the applications that were scheduled to be heard at this meeting have been carried over to the regular Zoning Board meeting to be held on April 21, 2016 at 8:00 pm in these Council Chambers and that he will not be receiving any further notice regarding this.

Chairman Neuer also stated that the proposed special Zoning Board meeting for April 7, 2016 is not going to be held. He said that it is his understanding that the two (2) Executive West, LLC applications have been withdrawn by the applicant without prejudice. Chairman Neuer stated that the attorneys for both of the applications that were scheduled to be heard tonight have signed the appropriate paperwork agreeing to have the applications carried and extending the statutory period for rendering decisions.. Chairman Neuer asked Ms. Beirne if there is anything else that should be stated for the record; she replied no. The meeting was adjourned by Chairman Neuer at 8:14 pm.
