1 Conference Meeting – November 22, 2016 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, and 66 Main Street, West Orange, New Jersey at 6:38 p.m. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Public Law, 1975. A notice of this meeting was emailed to the Star Ledger and the West Orange Chronicle on October 14, 2015. Roll Call: Present: Councilwoman Casalino, Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Council President Cirilo and Mayor Parisi. A promotion ceremony was held on behalf of the West Orange Fire Department. Carmine Ruta was promoted to the rank of Fire Captain. The Honor Guard opened up the meeting with the Pledge of Allegiance. A Citation was given to Father Dominick Lenoci on behalf of St. Joseph’s Church 85th Anniversary. Perry Bashkoff gave an update with regard to social media on behalf of the Township. Jack Sayers updated the council about redevelopment. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Public Law, 1975. A notice of this meeting was emailed to the Star Ledger and the West Orange Chronicle on October 14, 2015. Roll Call: Present: Councilwoman Casalino, Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney and Council President Cirilo. At 7:22 p.m., on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the council entered into an executive session for the purpose of discussing resolution 255-16 Resolution Authorizing an Executive Session for the Purpose of Discussing Litigation – West Essex Highlands. There was no one else who wished to be heard and the public hearing was closed. *Review of Consent Agenda *Approval of Minutes of Previous Meeting The October 26, 2016 Public Meeting minutes were approved as amended. *Resolution(s) adopted on Consent Agenda: a. **236-16 Resolution Repealing and Revising Resolution 224-16 Authorizing the Mayor to Execute and Submit an Electronic Grant Application Identified as TA-2016-West Orange Town Township-00073 to the New Jersey Department of Transportation for Funding under the TAP on behalf of the Township; and the Township’s Municipal Engineer/Director of Public Works, Mr. Leonard Lepore P.E. 3 h. 243-16 Resolution Authorizing the Township to Direct a Municipal Official to Participate in the Online Public Auction for the Tax Sale Certificate a Certain Property on Behalf of the Township per N.J.S.A. 54:5-30.1 (Legal-Moon) This resolution authorizes the Township’s Chief Financial Officer to bid on the online tax sale certificate auction pertaining to the property at 27 Mitchell Street, a property within the Central Valley Corridor. i. 244-16 Resolution Authorizing the Township to Accept Essex County’s Quit Claim Deed Vacating the Road Widening Easement and Dedicate the Proposed 15-foot Wide Right of Way Along with the Proposed 5-foot Slope Easement to the County of Essex via a Deed of Dedication for Property Located at 296 Prospect Avenue, Block 111, Lot 1 (Legal-Trenk) j. 246-16 Resolution Authorizing a Subordination of Mortgage for Property Located at 15 Westminster Dr., Block 155.08, Lot 4 (Legal-Moon) k. 247-16 Resolution Authorizing the Issuance of Raffle Licenses (Clerk) l. 248-16 Introduction of the 2017 Downtown West Orange Alliance Budget (Brill) m. 249-16 Resolution Stating No Objection to the Rock Spring Country Club’s Issuance of a License For Use of A Helicopter to Deliver Santa Claus (Clerk) This resolution would state that the Township Council does not object to the Rock Spring Club’s application for a temporary license to the New Jersey Department of Transportation. A temporary license is needed in order for the Rock Spring Club to have a helicopter land at the club property to deliver Santa Claus to club members and their guests in attendance for a holiday celebration on December 18, 2016 at approximately 1:30 p.m. n. 250-16 Resolution Authorizing an Appropriation Transfer Pursuant to N.J.S.A. 40A: 4-58 (Gross) o. 251-16 Resolution Authorizing a License Agreement with Richard Behar d/b/a Roseland Landscaping for the Use of the Property Located at 18 Central Avenue (Legal-Trenk) This property has been included as part of the redevelopment of the Central Valley Corridor. Mr. Behar will use the property solely for storage of vehicles and equipment and has agreed to pay the Township a monthly licensing fee of $400.00 for such use. p. 253-16 Resolution Awarding a Professional Services Contract to T&M Associates, 11 Tindall Road, Middletown, New Jersey 07748 to Provide Professional Environmental and Site Remediation Services and Licensed
6 Resolution Awarding a Professional Services Contract to T&M Associates, 11 Tindall Road, Middletown, New Jersey 07748 to Provide Professional Environmental and Site Remediation Services and Licensed Site Remediation Professional Services for the Old Public Works Garage, 6 Lindsley Avenue, Block 69, Lot 5 in Accordance with Their Proposal Dated July 13, 2016 for an Amount NTE $54,600.00. (Lepore) This Resolution authorizes a Professional Services Contract with T&M Associates of Middletown, New Jersey to provide additional site remediation services at the old Public Works Garage, 6 Lindsley Avenue, for contamination caused by leaking underground storage tanks.
4 q. 254-16 Resolution Authorizing an Award of Contract for Snow Plowing and Removal Services for Years 2016-17 to American Asphalt & Milling Services, LLC, Kearny, NJ, Grabowkski Construction, West Orange, NJ, Downes Tree Service, Inc., Hawthorne, NJ and Do-It-Right Technologies, Jersey City, NJ (Lepore) r. 255-16 Resolution Authorizing an Executive Session for the Purpose of Discussing Litigation – West Essex Highlands (Trenk) On motion made by Councilman Guarino and seconded by Council President Cirilo, the consent agenda was approved. All members voting “Aye.” Resolution(s) Removed from Consent Agenda Resolution 245-16 a. 245-16 Resolution Authorizing Authorization for Sale of Notes Special Emergency Appropriation Severance Liabilities Resulting from Accrued Leave in Connection with the Layoff or Retirement of Employees (Bond Counsel-Draikewicz) On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned resolution was approved. All members voting “Aye.” Resolution 252-16 b. 252-16 Resolution Approving Various Outstanding Tax Appeals (Legal-Trenk) On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned resolution was approved. All members voting “Aye.” Ordinance(s) on Second and Final Reading Ordinance 2494-16 a. On motion made by Councilwoman Casalino and seconded by Council President Cirilo, An Ordinance Authorizing Special Emergency Appropriation Pursuant to N.J.S.A. 40A:4053 for Severance Liabilities Resulting From Accrued Leave in Connection with the Layoff or Retirement of Employees was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only.
5 The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Guarino and seconded by Councilwoman Casalino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye.” Ordinance 2495-16 b. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, An Ordinance Amending Chapter 12, Section 11.6 of the Revised General Ordinances of the Township of West Orange – E Cigarette Licensing was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye.” Ordinance(s) on First Reading Ordinance 2496-16 a. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, An Ordinance Creating a Reclassification and Salary Schedule of Certain Township of West Orange Employees Setting Forth Their Titles, Classification and Salary Ranges and Adopting a Salary Guide and Establishing Employee’s Status as a Township Employee and Under the Guidelines of the New Jersey Department of Personnel was approved on first reading, ordered advertised according to law, to come up for second and final reading on December 6, 2016. All members voting “Aye”. Ordinance 2497-16 b. On motion made by Councilman Guarino and seconded by Councilwoman Casalino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.1, Handicapped Parking on Streets and Subsection 7-32.2, Restricted Parking Zones, of the Revised General Ordinances of the Township of West Orange - 13 Cross Street, 54 Ashland Avenue and 24 Ashwood Terrace was approved on first reading, ordered advertised according to law, to come up for second and final reading on December 6, 2016.
6 All members voting “Aye”. Pending Matters/New Matters/Council Discussion At this time the Council discussed the re-appointment of Bart Quentzel as Alternate No. 1 on the Zoning Board. On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, Mr. Quentzel was re-appointed to the Zoning Board. All members voting “Aye”. At this time, Councilman Krakoviak nominated Dr. Michael Straker for the position of Alternate #4 on the Zoning Board. The motion was seconded by Councilwoman McCartney. Councilwoman Casalino, Councilman Krakoviak, Councilwoman McCartney and Council President Cirilo voting “Aye.” Councilman Guarino voting “Nay.” At this time the Council members finalized the 2017 Township Council meeting dates. At 9:47 p.m., on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the meeting was adjourned. All members voting “Aye”.
