1 Conference Meeting – December 6, 2016 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, and 66 Main Street, West Orange, New Jersey at 6:44 p.m. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Public Law, 1975. A notice of this meeting was emailed to the Star Ledger and the West Orange Chronicle on October 14, 2015. Roll Call: Present: Councilwoman Casalino, Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Council President Cirilo and Mayor Parisi. Assemblyman John McKeon, Assemblywoman Miley Jasey and Senator Richard Codey made a presentation honoring Michael Fabiano. Councilmembers Jerry Guarino, Susan McCartney, Jerry Guarino and Victor Cirilo shared some fond memories of Mr. Fabiano. Mrs. Fabiano spoke fondly of her husband and thanked his family and friends for attending Jack Sayers gave an update on the Redevelopment on Main Street. There was no one else who wished to be heard and the public hearing was closed. *Review of Consent Agenda *Approval of Minutes of Previous Meeting The November 22, 2016 Public Meeting minutes were approved as well as the October 26, 2016 and the November 22, 2016 Executive Session minutes. *Resolution(s) adopted on Consent Agenda: a. 256-16 Resolution Refunding and Cancelling Taxes on a Now Exempt Property Due to a County Board Judgment (Gagliardo) b. 257-16 Resolution Authorizing an Agreement with the Essex County Division of Senior Services to Provide Partial Funding for Senior Citizen Public Health Nurse for the Contract Period of January 1, 2017 through December 31, 2017 in the Amount of $16,127.00 (DeNova) c. 259-16 Resolution Awarding a Contract for Providing Recreational, Social and Educational Services to the Senior Citizens of the Township of West Orange, for the Period Commencing January 1, 2016 and ending December 31, 2016. (DeNova) The following organizations are willing to provide said services; Pleasantdale Senior Citizens, JCC Council of Senior Citizens, The John Renna House, Eagle Rock Senior Citizens , H.A./Tenant Services, Woodland Valley Senior Social Gathering, Knitting Club Prime Timers d. 260-16 A Resolution Authorizing the Collector of Taxes to Refund Payment to the Listed Taxpayer for Property at 5 Parson Drive, Block 171.04 Lot 3 Due to a Senior Citizen Deduction That Was Granted (Gagliardo) e. 261-16 Resolution Authorizing the Collector of Taxes to Refund Payment to the Listed Taxpayer Due to a Duplicate Payment of Fourth Quarter 2016 Taxes (Gagliardo) f. 262-16 Resolution Authorizing the Collector of Taxes to Refund Payment to the Listed Taxpayer Due to an Overpayment of Taxes Due to a Payment Posted in Error-Taxpayer is a Tax Exempt Disabled Veteran (Gagliardo) On motion made by Councilwoman McCartney and seconded by Councilwoman Casalino, the consent agenda was approved. All members voting “Aye.” 1. Ordinances on Second and Final Reading a. 2496-16 An Ordinance Creating a Reclassification and Salary Schedule of Certain Township of West Orange Employees Setting Forth Their Titles, Classification and Salary Ranges and
3 Adopting a Salary Guide and Establishing Employee’s Status as a Township Employee and Under the Guidelines of the New Jersey Department of Personnel (Gross) b. 2497-16 An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.1, Handicapped Parking on Streets and Subsection 7-32.2, Restricted Parking Zones, of the Revised General Ordinances of the Township of West Orange - 13 Cross Street, 54 Ashland Avenue and 24 Ashwood Terrace (Lepore) On motion made by Councilman Guarino and seconded by Council President Cirilo, the consent agenda was approved. All members voting “Aye.” Resolution(s) Removed from Consent Agenda Resolution 258-16 g. 258-16 Resolution Authorizing the Payment of Legal Fees in the Amount of $121,059.69 to Charles Blau, Esq., Special Tax Appeal Counsel (Trenk) Blau and Blau successfully obtained increases in certain assessments from property owners as detailed on Schedule “A”. These increased tax assessments will lead to additional taxes totaling $363,179.08. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned resolution was approved. All members voting “Aye.” Ordinance(s) on Second and Final Reading Ordinance 2496-16 a. 4 On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye.” Ordinance 2497-16 b. On motion made by Councilwoman Casalino and seconded by Councilman Guarino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.1, Handicapped Parking on Streets and Subsection 7-32.2, Restricted Parking Zones, of the Revised General Ordinances of the Township of West Orange - 13 Cross Street, 54 Ashland Avenue and 24 Ashwood Terrace was taken up on second and final reading. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, An Ordinance Amending Chapter 7, Section 50.3 of the Revised General Ordinances of the Township of West Orange (Permit Parking in Hazel Avenue Parking Lot) was approved on first reading, ordered advertised according to law, to come up for second and final reading on December 20, 2016. All members voting “Aye”. Pending Matters/New Matters/Council Discussion At this time, on motion made by Councilman Guarino and seconded by Councilwoman Susan McCartney, the Council entered into an ABC Hearing. All members voting “Aye”. ABC Hearing a. 570-16 Person to Person Transfer of Plenary Retail Distribution License No. 0722-44-018-006 from Ketul Corp. to T&T Liquors, Inc., 110 Harrison Avenue.
5 On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned resolution was approved. All members voting “Aye.” b. 571-16 Person to Person and Place to Place Transfer of Plenary Consumption License No. 0722-33-025-009 from Mondial Consulting, LLC to Heritage Restaurant and Lounge, LLC. On motion made by Councilwoman McCartney and seconded by Councilwoman Casalino, the above mentioned resolution was approved. All members voting “Aye.” At 9:11 p.m., on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the meeting was adjourned. All members voting “Aye”.
