1 Conference Meeting – February 21, 2017 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, and 66 Main Street, West Orange, New Jersey at 6:40 p.m. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on November 28, 2016 and published in the West Orange Chronicle on December 8, 2016. Roll Call: Present: Councilwoman Casalino, Councilman Guarino, Councilwoman McCartney and Council President Krakoviak. Councilman Cirilo was detained at work and arrived after roll call. A presentation was made by Shirley Bishop, Affordable Housing Consultant with regard to Affordable Housing obligations in the Township. Jack Sayers gave an update on the Redevelopment on Main Street. There was no one else who wished to be heard and public comment was recessed. The Council responded at this time. *Review of Consent Agenda *Approval of Minutes of Previous Meeting The Public meeting minutes of February 7, 2017 were approved as submitted. *Resolution(s) adopted on Consent Agenda: a. 52-17 PULLED b. 53-17 Resolution Authorizing the Township to Purchase Title Insurance for Two Parcels of Properties Vested to the Township Following an In Rem Tax foreclosure (Legal-Moon) This resolution would authorize the Township to purchase title insurance for 18 Central Avenue and 7 Tompkins Street following the issuance and recording of a Final Judgment issued by the Court in the Township’s In Rem Tax Foreclosure on the properties. c. 54-17 Resolution Authorizing the Issuance of Raffle Licenses (Clerk) d. 55-17 Resolution Authorizing an Executive Session for the Purpose of Discussing Affordable Housing Issues and Potential Litigation/Claims (Trenk) e. 56-17 Resolution Authorizing the Execution of the 11th Amendment to the Agreement with Rutgers University for TB Consultation (Legal-Moon, DeNova) This resolution authorizes the Township to execute an eleventh amendment to the 2005 Agreement with the New Jersey Medical School Global Tuberculosis Institute at Rutgers University to extend the Township’s agreement for consultation services with the Township’s Tuberculosis Prevention and Control Program as mandated by the State of New Jersey. f. 57-17 Resolution Authorizing 2016 Reimbursement for Municipal Services - Llewellyn Park – Leaf Collection and Obstruction (Lepore) An Agreement pursuant to the Municipal Services Act between the Llewellyn Park Committee of Managers, a fee simple private community, and the Township provides for the reimbursement of leaf collection and disposal costs to Llewellyn Park based on costs the Township would incur in providing those services. This Resolution authorizes reimbursing Llewellyn Park for leaf collection and disposal services in 2016.

3 g. 58-17 Resolution Authorizing 2016 Reimbursement for Services to Private Communities- Snow Removal (Lepore) A State Statute, commonly known as the Municipal Services Act, requires a Municipality either provide services associated with snow and ice control or reimburse the private communities for costs the Township would incur in providing those services. This Resolution authorizes reimbursing 20 private communities for costs associated with snow and ice control in 2016. h. 59-17 Resolution Authorizing Matrix New World to Perform Concrete Testing at Properties Located Within the Central Valley Redevelopment Area (Legal-Moon) This resolution authorizes the Township to retain a professional to conduct concrete testing on the building located on the Selecto-Flash property for contamination. This testing is an initial measure in the Township’s efforts to demolish the building on the property which has fallen into disrepair. i. 60-17 Resolution Authorizing the Business Administer to Process an Involuntary Accidental Disability Retirement Application for a Township Employee (Admin) j. 61-17 Resolution Authorizing the Execution of an Interlocal Service Agreement Between the Township of West Orange and the Borough of Essex Fells for the Provision of Health Services for the Period of January 1, 2017 through December 31, 2019 (DeNova) k. 62-17 Resolution Authorizing the Retention of Goose Control Technology for the Year 2017 to Provide Goose Egg Treatment at Three (3) Sites for $2,500, and to Coordinate a Volunteer Nest Site Identification Program for a Flat Rate of $500, for a Total Contract Amount NTE $3,000 (DeNova) l. 63-17 Resolution Authorizing the Execution of an Interlocal Service Agreement Between the Township of West Orange and the Borough of Essex Fells for the Provision of Animal Control Services for the Period of January 1, 2017 through December 31, 2019 (DeNova) m. 64-17 Resolution Authorizing a Contract for Winding Way 2017 Roadway Improvements is to JTG Construction, Inc., 188 Jefferson Street, Suite 387, Newark, NJ 07105, in the Amount of $429,600.00 (Lepore) n. 65-17 Resolution Authorizing the Purchase and Installation of Two (2) Carrier 25 Ton Cooling/Gas Heating Rooftop Units or Approval Equivalent for the Township of West Orange Police and Justice Building to Simple Fix HVAC Professionals, 121 Executive Drive, Suite 300, New Windsor, New York

ing/Gas Heating Rooftop Units or Approval Equivalent for the Township of West Orange Police and Justice Building to Simple Fix HVAC Professionals, 121 Executive Drive, Suite 300, New Windsor, New York 12553, in the Amount of $63,000. (Lepore) o. 66-17 Resolution Authorizing a Budget Appropriation Transfer (Gross) On motion made by Councilman Guarino and seconded by Councilwoman Casalino, the consent agenda was approved. All members voting “Aye.” At this time the Council members went into executive session for the purpose of discussing the following:

4 55-17 Resolution Authorizing an Executive Session for the Purpose of Discussing Affordable Housing Issues and Potential Litigation/Claims At 10:08 p.m., the Council returned from Executive Session. Shirley Bishop addressed all questions that were asked during Public Comment with regard to Affordable Housing issues. Public Comment reconvened at this time. Dr. Thomas Colino – Walker Road Abe Bunis – 32 Bayowski Road There was no one else who wished to be heard and the public comment portion of the agenda was closed. Ordinance(s) on Second and Final Reading Ordinance 2505-17 On motion made by Councilman Guarino and seconded by Councilwoman Casalino, An Ordinance Amending Chapter 23, Sections 2.2, 2.3 and 2.4 of the Revised General Ordinances of the Township of West Orange - (Rate Schedule for the Rental and Use of Toby Katz Community Center was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. No one wished to be heard. On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye.” Ordinance 2506-17 On motion made by Councilwoman Casalino and seconded by Councilman Guarino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.2, Restricted Parking Zones of the Revised General Ordinances of the Township of West Orange – Handicapped Parking – 18 and 55 Chestnut Street and 24 Watchung Avenue was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard.

5 Ken Kayser made a few brief remarks. No one else wished to be heard. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye.” Pending Matters/New Matters/Council Discussion Councilman Cirilo invited his colleagues and the public to a forum being hosted by the West Orange Hispanic Foundation on February 26, 2017 to discuss Immigration issues. Mr. Sayers gave an update on the restoration of St. Mark’s Church and the auction of the Ridgeway Property. Councilwoman McCartney commended Mayor Parisi for holding a public forum for the property owners near the Ridgeway Property keeping them apprised of what was being planned for the property. At 10:38 p.m., on motion made by Councilwoman Casalino and seconded by Councilman Guarino, the meeting was adjourned. All members voting “Aye”.
