Eagle Rock Commercial Area in Need of Redevelopment Study Resolution #18-02

#18-02 RESOLUTION OF THE PLANNING BOARD TOWNSHIP OF WEST ORANGE WHEREAS pursuant to N.J.S.A. 40A:12A the Local Redevelopment and Housing Law (the “LRHL”) the Planning Board was directed by the West Orange Township Council pursuant to Resolutions #217-15 and #251-15, to conduct a preliminary investigation in order to investigate the area listed therein and generally described as the Eagle Rock Commercial Area Study Area (the “Study Area”) to determine if it should be determined to be an area in need of redevelopment or an area in need of rehabilitation under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq. (the “LRHL”); and WHEREAS the firm of H2M Associates, Inc. was engaged to conduct a study and make recommendations as to whether any or all of the properties within the Study Area met the criteria as an area in need of redevelopment or an area in need of rehabilitation; and WHEREAS H2M did conduct a study and prepare a report (the “Report”); and WHEREAS the Planning Board conducted a public hearing at meetings held on June 1, 2016 and August 3, 2016 after notice and made the following findings: 1. The Board having received the Report from H2M Associates, Inc. and having heard testimony from Jeffrey Janota, PP, AICP, and having provided an opportunity for public comment, and having deliberated on the matter, hereby finds that there is insufficient information at this time for it to determine whether any of the properties in the Study Area meet the statutory criteria. 2. The Board hereby tables any action on whether any of the properties meet the statutory criteria for a period not to exceed 12 months; and WHEREAS no further information has been received by the Board from H2M Associates, Inc. or the Township Council, employees, professional staff or any other interested stakeholders since the last hearing date on August 3, 2016; IT IS THEREFORE RESOLVED 69) The Board hereby determines that there has been insufficient information presented in order to determine that the Eagle Rock Commercial Study Area is an area in need of redevelopment or an area in need of rehabilitation.
