1 Conference Meeting – March 13, 2018 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 6:36 p.m., Karen J. Carnevale, Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on October 25, 2017 and published in the West Orange Chronicle on November 2, 2017. Roll Call: Present: Councilwoman Casalino, Councilman Cirilo, Councilman Guarino, Councilman Krakoviak, and Council President McCartney. Councilman Guarino presented a Citation on behalf of the Township Council to Mr. Albert Guadagno on the occasion of his 100th birthday. Also, in attendance was Mr. Guadagno’s daughter and son-in-law, Gail and Lyle Lauterbach. Megan Brill, Executive Director of the Downtown West Orange Alliance and Ron Raymond, Downtown West Orange Alliance Design Committee member, gave a presentation about design guidelines along the Downtown corridor that included an explanation of the permit application process for signage. Included in the presentation was a map of all the commercial properties within the Special Improvement District. Ms. Brill presented a facade grant check in the amount of $1,952.00 to Jim Fitzgerald, Esq., Fitzgerald & Crouch Law Firm that will be used to improve the law firm’s facade. Mr. Sayers gave an update on the progress of Phase I of the Redevelopment Project on Main Street. 2 The Council responded at this time. *Review of Consent Agenda *Approval of Minutes of Previous Meeting- Public Meeting and Executive Session February 27, 2018 *Report of Township Officers – Municipal Court February 2018 *Reading of Petitions and Communications and Bids – None *Resolution(s) adopted on Consent Agenda: Resolution 91-18 Authorizing an Executive Session for the Purpose of Discussing with Township Council a Matter of Potential Litigation-Affordable Housing Issues (Legal-Trenk) was pulled from the agenda prior to approval on consent. a. 87-18 Resolution Authorizing the Township to Retain Matrix New World to Perform Site Investigations at Degnan Park and Lafayette Park of Areas of Concern Identified in Preliminary Assessment Reports Performed as Part of the Township’s Multi-Park Development Project (Legal- Moon) b. 88-18 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey (Gagliardo) c. 89-18 Resolution Authorizing the Performance Bond Posted by DGP Urban Renewal, LLC Redevelopers of the Edison Lofts, 177 Main Street, West Orange, NJ 07052, Block 66, Lot 1 in the Amount of $1,683,337.20 to Guarantee the Installation of Certain Site Improvements, be Reduced by $1,007,034.00, which Reflects the Value of Improvements Made to Date, to $676,303.20 (Lepore) d. 90-18 Resolution Authorizing the Subordination of the Township’s Mortgage on the Property at 89 Watchung Avenue from the Township’s Housing Rehabilitation Program to Allow the Property Owners to Refinance Their Mortgage (Planning) On motion made by Councilman Guarino and seconded by Councilman Cirilo, the consent agenda was approved. All members present voting “Aye.” At this time, Ordinance 2538-18 was heard on second and final reading. Ordinance 2538-18 On motion made by Councilman Guarino and seconded by Councilman Cirilo, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-13, Parking Prohibited at All Times on Certain Streets, of the Revised General Ordinances of the Township of West Orange – Brook End Drive was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. 3 Steve Sinisi, Esq. representing Alaris Health West Orange asked that the Council defer the vote on the ordinance until March 27, 2018. He explained that he would offer a different solution to the parking problem. Matt Seckler, Stonefield Engineering and Design, LLC also representing Alaris Health of West Orange asked that action on the ordinance be deferred to allow the opportunity to collect data and further study the parking characteristics to develop a potential parkin regulation that better suits this specific roadway and user mix. Deanna Johnson 10 Brook End Drive asked the Council to pass the ordinance and explained that 4 out of the 5 homeowners on the street want the ordinance enacted due to parking issues. Lenny Lepore – Township Engineer Christine Giles – Administrator – Alaris Health West Orange There was no one else who wished to be heard and the public hearing was closed. On motion made by Council President McCartney and seconded by Councilwoman Casalino, the above - mentioned ordinance was held-over to be heard on second and final reading on March 27, 2018. All members voting “Aye”. Ken Kayser, Assistant Township Attorney marked the letter from Stonefield Engineering and Design, LLC dated March 13, 2018 as “Ordinance 2358-18-Exhibit 1.” Resolution(s) Removed from the Consent Agenda Resolution 86-18 86-18 Resolution authorizing the Township to Execute a Service Agreement with Goose Control Technology to Perform Services Related to Population Control of Canadian Geese at all Township Parks and Properties for the Year 2018 (Legal-Moon) On motion made by Councilman Cirilo and seconded by Council President McCartney, the above referenced resolution was approved. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Council President McCartney voting “Aye.” Councilman Krakoviak voting “Nay.” Ordinance(s) on Second and Final Reading Ordinance 2537-18 On motion made by Councilman Guarino and seconded by Councilwoman Casalino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-20, Stop Intersections of the Revised General Ordinances of the Township of West Orange – Overlook Avenue and Lawrence Avenue was taken up on second and final reading. 4 On motion made by Councilwoman Casalino and seconded by Councilman Guarino, the above - mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance 2539-18 On motion made by Councilwoman Casalino and seconded by Councilman Guarino, An Ordinance Amending and Supplementing Chapter 7, Traffic Subsection 7-32.1, Handicapped Parking on the Streets, of the Revised General Ordinances of the Township of West Orange – Pleasant Valley Way was taken up on second and final reading. All members voting “Aye”. The Council President asked if there was anyone who wished to be heard. Councilwoman Casalino expressed her concern about the close proximity of the driveway to Kelly Elementary School and wondered if there should be regulated hours for parking during drop off and pick up. Mr. Lepore explained that there is another driveway for the Cerebral Palsy New Jersey facility between the proposed parking stall and the school driveway so the stall is not immediately adjacent to the driveway. He stated there is plenty of room between where the handicapped stall is located and the driveway. He said that the parking problem during school hours is what precipitated the request for the handicapped parking spot for the facility. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilman Guarino and seconded by Council President McCartney, the above - mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”.
