1 Conference Meeting – September 4, 2018 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 6:33 p.m., Karen Carnevale, Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on October 25, 2017 and published in the West Orange Chronicle on November 2, 2017. Roll Call: Present: Councilwoman Casalino, Councilman Cirilo, Councilman Guarino, Councilman Krakoviak, and Council President McCartney. A presentation was made to the West Orange PAL Spring Travel Baseball Teams, 8U, 9U, 10U and 14U. Mr. Sayers gave a brief update on the redevelopment area. The Council responded at this time. *Review of Consent Agenda *Approval of Minutes of Previous Meeting- Public Meeting August 7, 2018 *Report of Township Officers – None *Reading of Petitions and Communications and Bids – None *Bills *Resolution(s) adopted on Consent Agenda: a. 192-18 Resolution Authorizing the Execution of the First Amendment to the Interim Redevelopment Agreement between the Township of West Orange and The Alpert Group, LLC (Legal-Maier) b. 193-18 Resolution Authorizing the Township to Execute a Release of Storm Easement (Legal-Maier) Valley Road Residential Urban Renewal, LLC owns certain property which according to the tax map contains a Storm Easement. The Storm Easement has been abandoned and removed, which has been confirmed by the Township Engineer. This resolution would authorize the Township’s application
3 and authorize the Mayor to execute the Certifications and Assurances, a requirement of the application. l. 203-18 Resolution Awarding a Contract to JESCO, Inc. Through Use of the Sourcewell (formerly NJPA) National Cooperative Pursuant to N.J.S.A. 52:34-6.2 (DeSantis) m. 204-18 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey (Gagliardo) n. 205-18 Resolution authorizing the Execution of an Administrative Consent Order with the Department of Environmental Protection Which Sets Forth the Procedures for Removing and Disposal Contaminated Building Materials from the Property at 18 Central Avenue and Extends the Timeframe for Removal and Disposal of the Materials until May 18, 2020 (Legal-Moon) o. 206-18 Resolution Authorizing the Execution of a Temporary Extension Agreement with Reliable Wood for the Operation of the Recycling Center (Legal-Moon) On motion made by Councilman Guarino and seconded by Councilman Cirilo, the consent agenda was approved. All members present voting “Aye.” Ordinances on Second and Final Reading Ordinance 2548-18 On motion made by Councilwoman Casalino and seconded by Councilman Guarino, An Ordinance Supplementing Chapter 5, adding section 8.8 and Chapter 18, adding section 18.10 to the Revised General Ordinances of the Township of West Orange was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. Ordinance 2549-18 On motion made by Councilwoman Casalino and seconded by Council President McCartney, An Ordinance Adopting Redevelopment Plan for Block 155, Lot 42.01, in the Township of West Orange, County of Essex, State of New Jersey was taken up on second and final reading. On motion made by Councilwoman Casalino and seconded by Council President McCartney, the above- mentioned ordinance was approved on second and final reading. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Council President voting “Aye.” Councilman Krakoviak voting “Nay.” Ordinance(s) on First Reading Ordinance 2550-18 On motion made by Councilman Guarino and seconded by Councilman Cirilo, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-20, Stop Intersections, of the Revised General Ordinances of the Township of West Orange was approved on first reading, ordered advertised according to law, to come up for second and final reading on September 25, 2018. All members voting “Aye”. Ordinance 2551-18 On motion made by Councilwoman Casalino and seconded by Councilman Guarino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.2 Restricted Parking Zones of the Revised General Ordinances of the Township of West Orange – Handicapped Parking Stall – 89 Ashland Avenue was approved on first reading, ordered advertised according to law, to come up for second and final reading on September 25, 2018. All members voting “Aye”. Pending Matters/New Matters/Council Discussion Council President McCartney asked Mr. Sayers to look into the transportation issues brought up at the Council meeting. Councilman Krakoviak asked for an update regarding the remediation of the Legionnaires disease. At 11:01 p.m., on motion made by Councilman Guarino and seconded by Councilman Cirilo, the public meeting was adjourned and the Council entered into an ABC Hearing. All members voting “Aye”. ABC Hearing ABC Resolution 611-18 and 612-18 a. 611-18 Resolution Authorizing an Executive Session for the Purpose of Deliberations Occurring after a Public Hearing That May Result in Imposition of a Civil Penalty or Suspension or Loss of License or Permit – Las Palmeras – (Adopted on August 21, 2018, Ratified September 4, 2018)
5 b. 612-18 Resolution Sustaining Charges Against Las Palmeras, Inc., t/a Las Palmeras Restaurant and Bar, 364 Valley Road, West Orange, NJ, Plenary Retail Consumption License #0722-33-045-005 (Legal-Kayser) – (Adopted on August 21, 2018, Ratified September 4, 2018) On motion made by Councilman Guarino and seconded by Councilman Cirilo, the above referenced resolutions were ratified. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Council President voting “Aye.” Councilman Krakoviak abstaining from the vote as he did not attend the hearings.
