1 Public Meeting – December 6, 2011 The Township Council of the Township of West Orange met in the Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. Roll Call: Present: Councilman Anderton, Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, and Council President Spango Absent : None The Township identified and presented for unanimous consent, Item 5 (Minutes), Item 6 (Communication), Item 8 (Bills), and Item 11 (Certain Resolutions). On motion made by Council President Spango and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Len Held, 158 Gregory Avenue, West Orange Rodolfo Rodriguez, Ashwood Terrace, West Orange Rosary Morelli, Ralph Road, West Orange Lee Saul, 47 Carteret Street, West Orange Mark Meyerowitz, 19 Howell Drive, West Orange There was no one else who wished to be heard and the public hearing was closed. 2 Letter from Mayor Parisi regarding the re- appointment of Sheila Otner to the West Orange Public Library Board effective January 1, 2012 and continuing through December 31, 2015. Bills The Bill List was received and ordered paid. A summary of the Bill List is attached. Resolutions With the exception of resolution 278-11 and 282-11, the following resolutions were adopted on consent agenda. 3 Jersey 08512 and the Township of West Orange across a portion of property at 8 Korwel Circle, Block 166, Lot 38 for a consideration of $6,000.00 Resolution #263-11 Resolution Authorizing an Award of Bid to Abbry Security Company, LLC Providing Unarmed Security Officers for West Orange Municipal Court at an Hourly Rate of $12.95, Approximately $20,500 Annually Ordinances on Second and Final Reading Ordinance #2336-11 On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 25, LOADING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE -16 LINDSLEY AVENUE, was taken up on second and final reading. All members voting “Aye” The Council President stated that this was the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Anderton, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2337-11 On motion made by Councilwoman McCartney and seconded by Councilman Krakoviak, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 7.3, TEMPORARY PARKING PROHIBITION FOR SNOW PLOWING AND REMOVAL, OF THE REVISED GENERAL ORDINANC ES OF THE TOWNSHIP OF WEST ORANGE – FOREST AVENUE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Victor Sanchez, 4 Forest Avenue, West Orange stated his concerns regarding the
4 abovementioned ordinance. There was no one else who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2338-11 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 13, PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – VALLEY ROAD, was taken up on second and final reading by title only. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Ordinance #2339-11 On motion made by Councilman Krakoviak and seconded by Councilman Anderton, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 32.2, RESTRICTED PARKING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, 15 MCKINLEY AVENUE, was taken up on second and final reading. Ordinance #2340-11 On motion made by Councilman Anderton and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPER 7, TRAFFIC, SUBSECTION 7- 14.7, ALTERNATE SIDE PARKING, SUBSECTION 7-12, PARKING PROHIBITED FOR STREET CLEANING AND MAINTENANCE SUBSECTION 7-7.3, TEMPORARY PARKING PROHIBITION FOR SNOW PLOWING AND REMOVAL, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – CHARLES STREET, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. Ordinance #2341-11 On motion made by Councilman Cirilo and seconded by Councilman Krakoviak, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 14.1c, NIGHT PARKING RESTRICTION, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – CARTER ROAD, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard.
6 Director Leonard Lepore commented on the abovementioned ordinance and responded to questions from Council. Business Administrator Jack Sayers read a letter in favor of the abovementioned ordinance. There was no one else who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Ordinances on First Reading Ordinance #2342-11 On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FOR THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL – FIRE FIGHTERS, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on December 19, 2011. All members voting “Aye”. Ordinance #2343-11 On motion made by Councilman Cirilo and seconded by Councilman Krakoviak, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL – FIRE SUPERIOR OFFICERS, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only.
7 Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Cirilo, the abovementioned ordinance was passed on second and final reading, ordered advertised according to law, to come up for second and final reading on December 19, 2011. All members voting “Aye”. Resolution #278-11 Resolution Authorizing the Chief Financial Officer to issue a check in the Amount of $199,430 payable to the Montclair Golf Club in full satisfaction of all claims Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #282-11 Award of a Professional Services Contract to PS&S, 67 B Mountain Boulevard, Extension, P.O. Box 4039, Warren, New Jersey 07059 for Mayfair District Storm Sewer Improvements, Construction Phase Services for a fee of $139,390 Following discussion and on motion made by Councilman Anderton and seconded by Councilwoman McCartney,the above mentioned resolution was adopted. Councilman Anderton, Councilman Cirilo, Councilwoman McCartney and Council President Spango voting “Aye”. Councilman Krakoviak voting “Nay”. On motion made by Council President Spango and seconded by Councilman Anderton, the Council went into Executive Session to discuss and matter of Litigation. All members voting “Aye”. Resolution #284-11 Executive Session – Litigation – Montclair Golf Settlement Following discussion and on motion made by Council President Spango and seconded by Councilman Anderton, the above mentioned resolution was adopted. ABC HEARING Resolution #471-11, Renewal for 2011-2012 License Term, Rock Cellar, License No. 0722-33-051-007 On motion made by Councilman Anderton and seconded by Councilman Cirilo, the above
