WEST ORANGE TOWNSHIP PLANNING BOARD RESOLUTION NO. 20-07 RESOLUTION APPOINTING DAVID SPATZ, P.P., AICP AS SUBSTITUTE BOARD PLANNER FOR SPECIAL MEETINGS ON NOVEMBER 18 AND 19 2020. WHEREAS, on September 11, 2020, the New Jersey Superior Court Appellate Division reversed the designation of Essex Green and Executive Drive consisting of approximately seventy (70) acres as an area in need of redevelopment; and WHEREAS, the Appellate Division Decision reflected certain new statutory provisions of the Local Redevelopment and Housing Law, N.J.S.A. 40A:12-5, and the issues which it found existed in the earlier redevelopment process; and WHEREAS, on September 22, 2020, the Township Council adopted Resolution No. 178- 20 which referred to the Planning Board consideration of a smaller area consisting of less than approximately thirty (30) acres on Executive Drive with regard to whether it meets the current criteria to be deemed an area in need of redevelopment; and WHEREAS, special meetings of the Planning Board have been publicly noticed for November 18 and 19 (if necessary) 2020 to consider these matters; and WHEREAS, Paul Grygiel, the Township’s Planner, has determined to recuse himself from the new redevelopment study since he had previously been involved with the prior redevelopment study; and. WHEREAS, the Planning Board has requested a separate planner be present at its meetings when the redevelopment study is presented; and WHEREAS, Susan Gruel of Heyer Gruel & Associates is preparing the new redevelopment study; WHEREAS, the Township Council approved Resolution 211-20 (Attached hereto as Exhibit A) authorizing retention of David Spatz to assist the Planning Board on November 18 and 19 2020; and WHEREAS, David Spatz, in order to assist the Board, will be responsible for a thorough study of the Township’s Planning and Zoning Documents, including the Township’s Updated Master Plan. NOW THEREFORE, BE IT RESOLVED BY THE PLANNING BOARD OF THE TOWNSHIP OF WEST ORANGE, that David Spatz is hereby appointed for the purposes of assisting the Planning Board, in place of Paul Grygiel, at its aforementioned special meetings on the evenings of November 18 and 19 (if necessary) 2020;

WHEREAS, David Spatz has had no prior involvement in this matter; and WHEREAS, David Spatz’s hourly rate is $175.00; NOW THEREFORE, BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that David Spatz may be retained at a rate of $175.00 per hour not to exceed $2,100.00 for the purposes of assisting the Planning Board in this matter; and be it further RESOLVED, that this retention is below the bid threshold amount and is not being conducted through a fair and open process.
