1 Public Meeting – April 24, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 7, 2011. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, and Council President Spango Absent : Councilman Anderton The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 7 (Report), Item 8 (Bills), and Item 11 (Certain Resolutions). On motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members present voting “Aye”. Public Comment The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. Anthony Pugliese, Public Information Officer for Essex County Jeryl Maglio, owner of property located at 200 Pleasant Valley Way, West Orange Rosary Morelli, Ralph Road, West Orange Windale Simpson, Hillside Avenue, West Orange Sidney Hicks, 74 Mitchell Street, West Orange Jim Mitchell, 69 Mitchell Street, West Orange There was no one else who wished to be heard and the public hearing was closed. 2 The Public Minutes of March 20, 2012 were approved as submitted. Report The Municipal Judge’s Report for the Month of March, 2012 was received and placed on file. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #74-12 Resolution to Read the 2012 Municipal Budget by Title Resolution #75-12 Resolution Authorizing a Partial Refund of Real Estate Taxes Paid in the Amount of $2,041.99 for the 4th Quarter of 2010 for Block 86.04, Lot 5-4 Highland Place Pursuant to NJS 54:4-3.30 et. seq. – Disabled Veteran Resolution #76-12 Resolution Authorizing a Professional and Environmental Engineering Services Contract, Firm of Birdsall Services Group, 65 Jackson Drive, Cranford, NJ 07016 to Perform a Limited Site Investigation for Property Known as Block 159.08, Lot 55 – Edgewood Avenue in the Amount of $4,500.00 Resolution #77-12 Resolution Authorizing the Township of West Orange to Obtain a Grant from the State of New Jersey to Fund an Intensive Level Cultural Resource Survey Meeting the Scope of Work Requirements Set Forth by the NJ State Historic Preservation Office and the U.S. Department of the Interior’s National Park Service in an Effort to Update the Township’s Survey of Historic Site Published in 1992. Resolution #78-12 Resolution Authorizing Tax Refunds Due to Duplicate Payments for First Quarter 2012 Resolution #79-12

3 Resolution Authorizing a Contract for Emergency and Non Emergency Tree Services with Kevin Downes Tree Service, Inc., 65 Royal Avenue, Hawthorne, NJ in the Amount of $1,272.00 (Emergency) Hourly and $842.00 (Non Emergency) Hourly Resolution #80-12 Resolution Authorizing a Contract for Tree Removal Services with Dujet Tree Services, 54 Notch Road, West Paterson, NJ in the Various Amounts Indicated on the Resolution Ordinances on Second and Final Reading Ordinance #2356-12 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, SUBSECTION 7-14.1C, NIGHT PARKING RESTRICTED, SUBSECTION 7-14.2A, PARKING PROHIBITED ON CERTAIN STREETS DURING CERTAIN HOURS OF CERTAIN DAYS AND SUBSECTION 7- 14.7, ALTERNATE SIDE PARKING, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – MITCHELL STREET AND HAZEL AVENUE, was taken up on second and final reading. All members present voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Ms. Meredith Mitchell, Mitchell Street, West Orange commented on the above ordinance. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned ordinance was voted down. All members present voting “Aye” to vote down the above ordinance. Ordinances on First Reading - None Public Hearing on 2012 Local Municipal Budget On motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the public hearing on the 2012 Local Municipal Budget was opened. All members present voting “Aye” as the roll was called. The Clerk stated that this was the scheduled time for the public hearing on the Local Municipal

4 Budget for 2012 which was introduced on March 20, 2012, and was advertised in full as required by law, on April 12, 2012, together with a notice of hearing for this time. “Printed copies of the budget have been made available to the public and a supply is here for anyone desiring a copy.” Council President Spango stated “Anyone who has secured a copy of the budget may now do so.” Before opening the hearing, I wish to outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time, in order of rising, as nearly as I can determine. Would anyone like to be heard?” Sheila Lefkowitz, Pleasant Valley Way, West Orange commented on the 2012 Local Municipal Budget. There was no one else who wished to be heard at this time. On motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the Public Hearing on the 2012 Local Municipal Budget was closed. All members present voting “Aye” as the roll was called. Resolution #62-12 Resolution Calling for the Restoration of Energy Taxes to Municipalities (tabled by the Township Council on 4/3/12) Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned resolution was tabled until the May 15, 2012 Council Meeting. All members present voting “Aye”. Resolution #73-12 Resolution Authorizing a Modification to the Contract with GTBM, Rutherford, NJ for E-Ticketing Turn Key System Whereby the Minimum Ticket Obligation Shall Be Effective January 1, 2012 – December 16, 2016. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was tabled until the May 15, 2012 Council Meeting. All members present voting “Aye”.

5 Resolution #81-12 Resolution Ratifying the Retention of Edwin Matthews, Esq. of Bourne, Noll & Kenyon, Summit NJ to Provide Adequate and Competent Counsel to the Municipal Clerk in Her Review of the Submitted Referendum Petitions in the Amount of $150 Per Hour with a Cap of $3,000 Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was adopted. Councilman Cirilo, Councilwoman McCartney, and Council President Spango voting “Aye”. Councilman Krakoviak voting “Nay”. The Minutes of this meeting are on file in the Office of the Municipal Clerk. On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the meeting was adjourned at 8:33 P.M. All members present voting “Aye”. KAREN J.
