AFRAN: Also I would like to, before Mr. Goll leaves, we do need to move his report into evidence. I want to move his report. MS. MCGOVERN: You already marked it for identification. MR. AFRAN: Right. MS. McGOVERN: It's in evidence. MR. AFRAN: I didn't know it was marked. MS. MCGOVERN: Yeah, no. It's O-21. MR. AFRAN: Great. Thank you. At the last meeting Mr. Pannullo wanted to make reference to and introduce certain documents. The Chair said he felt that would not be relevant to be a part of the record for reasons discussed at that time. I have been asked by my client to identify those documents for the record Mr. Pannullo was proffering, so we have a reference point just to what he was proposing. CHAIRMAN BAGOFF: These are the documents that predate, as I recall, this application? MR. AFRAN: No, they don't predate the filing of the application. They predate the hearing.

AFRAN: They predate the hearing and they concern certain legal issues that were raised by Mr. Potter, who was counsel before I came into this case. I did not have anything to do with these documents. CHAIRMAN BAGOFF: I'm going to request you send them to Ms. McGovern, she'll evaluate them and we'll have a decision the next meeting. Are they something that needs to be done between now and the next meeting? MR. AFRAN: It does not need to be done right now. It just needs to be done at some point so we identify what documents we're referring to. CHAIRMAN BAGOFF: We'll have Ms. McGovern look at them. You'll send a copy to Mr. Plocker? MR. AFRAN: Mr. Plocker has a copy. CHAIRMAN BAGOFF: Mr. Plocker has a copy. So Mr. Plocker will respond to Ms. McGovern, when she reviews the documents we'll come up with a solution at the next meeting. MR. AFRAN: Yeah, I understand you ruled they're not part of the record, but I want to identify what we are proffering so the records clear.

We don't need to do it tonight. CHAIRMAN BAGOFF: Okay. Thank you. Okay. The next regular Planning Board meeting will be Wednesday, September 3, 2025, 7:30 PM via zoom. And the next special meeting of the Planning Board will be held August 25, 2025, 6:30 PM here for West Essex Highlands application. No further notice would be required.
