AFRAN: The other point is that it's4 possible Mr. Green may have been mistaken in saying5 there was nothing on the drawing. My argument was under6 Field you have to show your connection is feasible, not7 merely that you've drawn it. Field is the same case,8 and I think legally we may have some debate about it's9 applicability.10 The other point is the quotation from Judge11 Goldman is not appropriate for this courts reliance. I12 have been repeatedly told we cannot rely on anything13 from that decision of this board because it's a separate14 case. Judge Goldman's statement about what the board15 needs to do in 2006 was a different plan with different16 evidence. I want to point out the environmental17 evidence we discussed here was not in that case, so it's18 not appropriate for the board to be asked to rely on19 Judge Goldman's direction in another case 16 years ago.20 CHAIRMAN BAGOFF: I'll answer that. I sat21 on the board during that time. We're not going to rely22 on Judge Goldman's decision. It was remanded back to23 reevaluate, so both sides would work together. The24 applicant did not come back to the Planning Board, there25 150 was no working together after that. So we're not1 relying on that decision.2 MR. AFRAN: That's all I wanted to point3 out.4 CHAIRMAN BAGOFF: Absolutely. And the board5 will be reminded during our discussion that we will not6 rely on that decision.7 MR. But there were many comments16 that, during these proceedings, that characterized the17 prior denial and they weren't correct. So I offered it18 just to clear that up. And as far as the document19 itself, just like the cases we cited, all though it's20 not a reported decision or the regulations I cited, we21 didn't put those in the record, it is a publically filed22 document with the Superior Court. We'll16 review the documents, review everything that has been17 said here this evening, all the public comments and we18 will have at least one meeting, possibly two before we19 vote on the application.20 So to that end, our next regular meeting of21 the Planning Board will held Wednesday, March 4, 2026 at22 6:30 PM in person and you can watch via zoom.
