Z:\Resolutions\2010\30-10 Stimulus Refund-Termanini (2).doc 30-10 February 9, 2010 RESOLUTION WHEREAS, On July 27, 2009, Governor Corzine signed into law the NJ Economic Stimulus Act of 2009; and WHEREAS, part of this law temporarily suspends the Non-Residential Development Fee Act, which requires developers to pay a 2.5% non-residential development fee; and WHEREAS, under the NJ Economic Stimulus Act of 2009 any developer that has paid the 2.5% non-residential development fee since July 17, 2008 is entitled to claim a .05% refund based on certain criteria; and WHEREAS, the Township of West Orange Department of Planning and Development has determined that Dr. Zafer Termanini is entitled to a refund in the amount of $3,500.00; and WHEREAS, the Township is entitled to seek a reimbursement from the State of New Jersey for any refunds issued as a result of the passage of this law; NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Chief Financial Officer be and hereby is authorized to issue a refund to Dr. Zafer Termanini, 95 Main Street, West Orange, New Jersey in the amount of $3,500.00, which funds shall be withdrawn from the Township’s Developer Fee Account.
