39-10 February 23, 2010 RESOLUTION WHEREAS, Judith Vacca ("Vacca") is the owner of real property commonly known as 10 Calvin Terrace, West Orange, new Jersey (Block147, Lot 11); and WHEREAS, Vacca is currently in the process of selling the aforesaid property: and WHEREAS, a title examination necessary to consummate the aforesaid sale has disclosed the existence of a mortgage secured loan by the Township to Vacca, at the aforesaid address, in the sum of $950.00; and WHEREAS, said loan was dated November 22, 1982 and recorded with the Register of Essex County on November 30, 1982 in Book 4962 at page 151; and WHEREAS, there is attached hereto as Exhibit "A" an Affidavit of Edward Coleman, Chief Financial Officer of the Township stating that to the best of his knowledge, information and belief the loan to Vacca was paid in full but the mortgage securing said loan was never cancelled of record; and WHEREAS, this Council is of the belief that the Township should take whatever steps are necessary to cancel said mortgage of record. NOW, BE IT HEREBY RESOLVED by the Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute all documents, and take any steps necessary to cancel the mortgage securing the aforesaid loan to.
