74-10 March 23, 2010 R E S O L U T I O N WHEREAS, in December 2002 the Township of West Orange completed its Open Space and Recreation Plan; and WHEREAS, the Open Space and Recreation Plan identified preserving privately held properties around the Township; and WHREAS, one of the privately held parcels is identified as Block 172.25, Lot 23 which is commonly known as 577 Mt. Pleasant Avenue; and WHEREAS, the Township desires to purchase Block 172.25, Lot 23 which is identified as a potential property for acquisition in the Open Space and Recreation Plan which was approved by the Green Acres Program; and WHEREAS, the Township of West Orange applied for and received Planning Incentive Grants for property acquisition for open space preservation and recreation purposes from the Green Acres Program; and WHEREAS, the Green Acres Program has regulations and guidelines which must be followed before they will approve the purchase of any parcel using Planning Incentive Grant Funds which includes the preparation of a Preliminary Assessment Report; and WHEREAS, THE Birdsall Services Group/The PMK Group, Inc of Cranford, New Jersey prepared a Preliminary Assessment Report dated February 26, 2010; and WHEREAS, the Preliminary Assessment Report identified several areas of concern some of which require additional investigation as required by the Green Acres Program; and WHEREAS, the Birdsall Services Group/The PMK Group, Inc. of Cranford, New Jersey submitted a proposal dated March 15, 2010 to perform Site Investigation Services for this parcel for a fee of $29,800.00; and WHEREAS, the Birdsall Services Group/ The PMK Group has performed similar work for the Township and the Municipal Engineer recommends their services be obtained for this report; and WHEREAS, this work is considered a professional service which does not required competitive

bidding per N.J.S.A.40A:11-5(a)(i); and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that the Professional and Environmental Engineering Services of the firm The Birdsall Services Group/ The PMK Group, Inc. of Cranford, New Jersey be obtained to perform Site Investigation Services for property in the Township of West Orange known as Block 172.25, Lot 23, 577 Mt. Pleasant Avenue in accordance with their proposal dated March 15, 2010 for a fee of $29,800.00. BE IT FURTHER RESOLVED that a copy of this resolution be published in the West Orange Chronicle within 10 days of approval in accordance with N.J.S.A. 40A:11-5(1)(a)(i). Karen J.
