103-10 April 27, 2010 Resolution to Reject 2010 Tires & Tubes for Municipal Vehicles Bid and Awarding State Contract # A71688 for 2010 Tires and Tubes Purchases WHEREAS, the Township of West Orange did advertise for bidders on November 28, 2009 for 2010 Tires & Tubes for Municipal Vehicles & Trucks; and WHEREAS, three (3) bidders did submit on December 8, 2009 at the time and place designated; and WHEREAS, the Township of West Orange Department of Public Works and the Purchasing Agent did review all three submissions and found each not responsive to the specifications written; and WHEREAS, all three companies submitted State Contract pricing in their bids for all brand tires specified in the bid, only one company offered a small discount for one particular brand of tire; and WHEREAS, Municipal Vehicles and Trucks vary in the brand of tire used, the discount on one brand was not acceptable; and WHEREAS, all three companies are State Contract Vendors, it is advantageous to award to all three companies for the year 2010, a contract pursuant to the provision of N.J.S.A. 40A:11-12.; and WHEREAS, the amount in the 2010 operating budget for this expenditure is $46,000.00. THERFOR BE IT RESOLVED, by the Council of the Township of West Orange to reject the bids received on December 8, 2009 and award to the same as State Contract Vendors: Inter City Tire & Auto Center F & S Tire Corp., Inc. Orange Tire & Auto Service 777 Dowd Ave. 58 Brunswick Ave. 154 Central Ave. Elizabeth, NJ 07201 Edison, NJ 08817 Orange, NJ 07050 BE IT FURTHER RESOLVED that the Business Administrator is hereby authorized to arrange to pay for the foregoing in accordance with the terms of said Purchase Order on behalf of the Township of West Orange from funds certified by the Chief Financial Officer.
