117-10 May 25, 2010 R E S O L U T I O N WHEREAS, N.J.S. 40A:5-4 requires the Township of West Orange to have made an annual audit of its books, accounts, and financial records; and WHEREAS, the Township received a written proposal from Francis M. McEnerney of McEnerney, Brady & Company, LLC to conduct the aforesaid audit for 2010 for the sum of $41,500.00; WHEREAS, this Council desires to award a contract to Francis M. McEnerney of McEnerney, Brady & Company, LLC to conduct an audit for 2010; and WHEREAS, funds are or will be made available for this purpose; and WHEREAS, this contract may be awarded without competitive bidding, pursuant to N.J.S. 40A:11-5(1)(a)(i), as a “professional service”, and WHEREAS, there is attached hereto and made a part hereof a letter from Francis M. McEnerney of McEnerney, Brady & Company, LLC setting forth the written proposal referred to above. WHEREAS, award of this contract without competitive bidding is in the best interests of West Orange since McEnerney, Brady & Company, LLC has vast experience in the area of auditing. NOW, THERFORE BE IT FURTHER RESOLVED by the Township Council of the Township of West Orange does hereby appoint Francis M. McEnerney of McEnerney, Brady & Company, LLC to conduct an audit for 2010 of the Township’s books, accounts and financial records in accordance with state laws at an annual fee of $41,500.00 as set forth in the attached letter. BE IT FURTHER RESOLVED that the Township Attorney’s office prepare a written contract between the Township of West Orange and McEnerney, Brady & Company, LLC for approval by this Council and execution by the Mayor.
