Funding for this project will be made by the Essex County Recreation and Open Space Trust Fund. . Enclosed are the following proposals for the respective playground facilities: 1. Two (2) Handball Courts- The firm of Art Herder, Inc. with offices located at 18 South Cedar Parkway, Livingston, New Jersey 07039 submitted the lowest qualified bid for an amount of $13,700.00 to provide the required improvements to the two (2) handball courts. Two other proposals were obtained from the following qualified contractors: 1. Amadon Construction, Inc. Short Hills, New Jersey 07078 For: $14,200.00 2, Millner Specialty Contracting, LLC Verona, New Jersey 07462 For: $14,600.00

2. Two (2) Basketball Courts. Hockey Rink and Four (4) Tennis Courts- The firm of Dimilia, Inc. P.O. Box 3366 Memorial Station, Upper Montclair, New Jersey 07043 submitted the lowest qualified bid for an amount of $21,450.00 to provide the required improvements to the two basketball courts, the hockey rink & the four tennis courts, one (1) other proposal was obtained from a qualified contractor: 1. S.Lembo Construction LLC 18 Harvest Avenue East Hanover, New Jersey 07936 For: $23,100.00 This office attempted to obtain proposals from other contractors, however their total sum for the prespective facilities exceeded the total costs bid submitted by DiMilia, Inc. These firms have done similar work for the Township and their work has been excellent with no problems encounter. Considering the forgoing I recommend this project be awarded to Art Herder, Inc. with offices at 18 South Cedar Parkway, Livingston, New Jersey and to Dimilia, Inc. P.O.Box 3366, Memorial Station, Upper Montclair, New Jersey 07043. A Resolution of Award is attached subject to the approval of the Township Attorney. RESOLUTION WHEREAS, the Township of West Orange requested proposals for the playground improvements (baseball courts, handball courts and hockey rink) at O’Connor Park, Ralph Road West Orange, New Jersey; and WHEREAS, three (3) proposals were obtained from qualified contractors to provide the proper improvements to the two (2) existing handball courts and the lowest proposal in the amount of $13,700.00 was submitted by Art Herder, Inc. with offices located at 18 South Cedar Parkway, Livingston, New Jersey 07039; and WHEREAS, two (2) proposals were obtained from qualified contractors to provide the proper improvements to the two (2) existing basketball courts, the existing hockey rink and the four (4) existing tennis courts and the lowest proposal in the amount of $21,450.00 was submitted by Dimilia, Inc. with offices located at P.O. Box 3366, Memorial Station, Upper Montclair, New Jersey 07043; and WHEREAS, the total cost of both these contracts for the O’Connor Park improvements is $35,150.00; and WHEREAS, the Township of West Orange has had good experience with these firms; and WHEREAS, the Municipal Council of West Orange has considered said proposals; and has further considered the recommendations of the Township Engineer as to the award said proposals; and WHEREAS, the Township Engineer reported that the successful bidders complies with the bid specifications and the lowest responsible bidders.

| NOW THEREFORE IT BE RESOLVED by the Municipal Council of the Township of West Orange that the contract for the playground improvements at O’Connor Park located at Ralph Road hereby be awarded to the following firms: 1. Art Herder, Inc. 18 South Cedar Parkway Livingston, New Jersey 07039 (Handball Courts) $13,700.00 2 Dimilia, Inc. P.O.
