161-10 June 29, 2010 R E S O L U T I O N WHEREAS , on June 10, 2010 a contractor who was replacing the sanitary sewer service lateral connection for the property at 580 Valley Road advised the Township that a portion of the original easterly sanitary trunk sewer was broken; and WHEREAS, due to the depth and size of the sewer main its reconstruction was beyond the capabilities of the Public Works Department; and WHEREAS , the reconstruction needed to be performed on an expedited basis to prevent obstructions within the sewer and to reopen Valley Road; and WHEREAS, the Municipal Engineer contacted the firm of Grabowski Construction, Inc. of 770 Northfield Avenue, West Orange, New Jersey to perform emergency construction; and WHEREAS , Grabowski Construction, Inc. submitted a proposal dated June 11, 2010 to perform the emergency construction for a fee of $25,080 which excluded police traffic directors; and WHEREAS , this proposal was acceptable to the Municipal Engineer who authorized the work; and WHEREAS , Grabowski Construction, Inc. performed the construction to the sanitary sewer on June 12, 2010, and they repaired the pavement on June 14, 2010 for a final fee of $31,460.00; and WHEREAS , the final fee included the costs of Police Traffic Directors and some additional costs for a larger excavation; and WHEREAS , the final cost is acceptable to the Township Engineer. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in the amount of $31,460 is authorized to pay Grabowski Construction, Inc. for emergency sewer construction to the Township’s sanitary sewer main in front of 580 Valley Road. BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts N.J.S.A. 40A:11-6. Karen J.
