165-10 June 29, 2010 RESOLUTION WHEREAS, the Township of West Orange entered into a contract with DLS Contracting with offices at 633 Franklin Avenue, Nutley, New Jersey 07710 on August 18, 2009 for the 2009 Phase IV Street Improvements- Various Streets in an amount of $1,579,630.98 which reflected the base bid and certain selected alternates; and WHEREAS, the Township Council by Resolution No. 206-09 dated August 11, 2009 awarded this contract to DLS Contracting; and WHEREAS, the Township proposes to up-grade and pave the existing deteriorated parking lot at O’Connor Park, Ralph Road, West Orange; and WHEREAS, DLS Contracting submitted as part of their proposal an alternate “E” “Unit prices for additional work”, which is attached hereto; and WHEREAS, the estimated construction costs to perform the required work is $72,444.16; and WHEREAS, funding in the amount of $68,897.78 for this project will be provided by the Essex County Park Department under the 2009 Essex County Recreation and Open Space Local Aid Program; and WHEREAS, the balance of the estimated construction costs in the amount of $3,546.38 is to be funded from the 2009 Capital Budget; and WHEREAS, the Township Engineer recommended this work as being necessary and beneficial for the safety and welfare of the public; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE IT BE RESOLVED by the Township Council of the Township of West Orange that construction costs in the amount of $72,444.16 for the up-grade and paving of O’Connor Park Parking Lot by DLS Contracting is hereby approved and the Township Council further authorizes Leonard R.
