Public Meeting – May 3, 2011 The Township Council of the Township of West Orange met in the Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango, and Council President Anderton Absent: None The Township identified and presented for unanimous consent, Item 5 (Minutes), Item 6 (Communication), Item 8 (Bills) and Item 11 (Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Robert Goldsmith, a resident of Bel Air in West Orange, commented on the recent revaluation. There was no one else who wished to be heard and the public hearing was closed. Minutes The Public Minutes of March 29, 2011 were approved as submitted. Communication Correspondence from Chief Financial Officer, Edward J. Coleman Regarding Bond Anticipation Notes Awarded to Jeffries and Company, Totaling $11,505,000.00 and bear a Net Interest Rate of 0.59% (Net Interest Cost - $6,787.75. The Notes are Dated May 2, 2011 and will mature on June 8, 2011. Bills The Bill List was received and ordered paid. Summary of the Bill List is attached. Resolutions: 1

The following Resolutions were adopted: Resolution #92-11 Resolution to Read the 2011 Municipal Budget by Title Resolution #93-11 Resolution Authorizing Raffle Licenses Resolution #94-11 Resolution to Acquire (5) 2010 Marker Ford Crown Victoria Police Vehicles Through Cranford Cooperative Lease/Purchase Program Contract #101 Resolution #95-11 Award of Bid for Athletic Equipment & Clothing to Mike Shannon Sports Resolution #98-11 Resolution – Emergency Temporary Appropriations - 2011 Resolution #101-11 Resolution Authorizing an Award of Contract to Aquarious Capital Solutions Group, LLC in the Amount of $8,000 for Post Employment Benefits Valuation Including Data Gathering, Review of Assumptions, Valuation Report and Sensitivity Analysis Ordinance on Second and Final Reading Ordinance 2317-11 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-12, PARKING PROHIBITED FOR STREET CLEANING AND MAINTENANCE, AND CHAPTER 7, TRAFFIC, SUBSECTION 7-13 PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. 2

On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinances on First Reading Ordinance #2318-11 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (Handicapped Parking Stalls, 56 Elm Street and 9 Wheeler Street), was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on May 17, 2011. All members voting “Aye”. Ordinance #2319-11 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 25-24.1(d) OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on May 17, 2011. Award of Bid on State Contract T-1316 with NACR, Inc., 246 Industrial West, Eatontown, NJ 07724 in the Amount of $235,881.26 for the Purchase and Installation of Telecommunication Equipment Upgrade John Marchetto, a representative of NACR, Inc., gave a brief overview regarding the above and responded to questions from Council. Anne DeSantis, Purchasing Agent responded to questions from Council regarding the above. Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman Spango, the above mentioned resolution was tabled. All members voting “Aye” to table. Resolution #97-11 Resolution Authorizing the Award of Contract to TRC Environmental Corporation, 57 East Willow Street, Millburn, NJ to Provide Environmental Consulting Services for 22-24 Central Avenue, West Orange for an Amount NTE $40,910 Joseph Alpert of the Alpert Group, commented on the above resolution and responded to questions from Council. Deputy Director Borg also commented on the above resolution. Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #99-11 Resolution Authorizing a Subordination of Mortgage for 162 Maple Street, West Orange, NJ Lot 12, Block 145 Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the abovementioned resolution was adopted. All members voting “Aye”. Resolution #100-11 Resolution Authorizing Change Order No. 1 with Automatic Door Systems, 84 Porete Avenue, North Arlington, NJ 07031, in the Amount of $5,149.86, an Increase of 4.5 Percent of the Original Contract Amount of $114,800.00 for Construction of Entrance Canopy Enclosure Addition to West Orange Police Facility Gerry Huegel, Senior Architect responded to questions from Council. 4

Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman Spango, the council amended the the above mentioned resolution. All members voting “Aye” to amend. On motion made by Councilman Cirilo and seconded by Councilwoman Spango, the abovementioned resolution was adopted. All member s voting “Aye”. Resolution #102-11 Resolution Authorizing an Executive Session to Discuss Contract Negotiations Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned resolution was added to the agenda and adopted. All members voting “Aye”. Public Hearing on 2011 Local Municipal Budget On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the public hearing for the 2011 Local Municipal Budget was opened. All members voting “Aye” as the roll was called. The Clerk stated that this was the scheduled time for the public hearing on the Local Municipal Budget for 2011 which was introduced on March 29, 2011, and was advertised in full as required by law, on April 14, 2011, together with a notice of hearing for this time. “Printed copies of the budget have been made available to the public and a supply is here for anyone desiring a copy.” Council President Anderton stated “Anyone who has secured a copy of the budget may now do so.” Before opening the hearing, I wish to outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time, in order of rising, as nearly as I can determine. Would anyone like to be heard?” Earl Turner, Mt. Pleasant Avenue, West Orange commented on the 2011 Local Municipal Budget. Brian Goldberg, Pleasant Valley Way, West Orange commented on the 2011 Local Municipal Budget. Richard Goldsmith, a resident of Bel Air, West Orange also commented on the 2011 Local Municipal Budget. There was no one else who wished to be heard at this time. 5

On motion made by Councilman Krakoviak and seconded by Councilwoman MCartney, the Public Hearing on the 2011 Municipal Budget was closed. All members voting “Aye” as the roll was called. The Minutes of this meeting are on file in the office of the Municipal Clerk. On motion made by Council President Anderton and duly seconded, the meeting was adjourned at 8:39 P.M.
