1 Public Meeting – May 31, 2011 The Township Council of the Township of West Orange met in the Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango, and Council President Anderton Absent: None The Township identified and presented for unanimous consent, Item 5 (Minutes), Item 6 (Communication), Item 7 (Report), Item 8 (Bills), and Item 11 (Certain Resolutions). On motion made by Councilwoman McCartney and seconded by Councilman Krakoviak, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Brian Mann, 57 Mountain Avenue, West Orange commented on Ordinance #2323-11 listed for first reading this evening, concerning the Reconstruction of the System of Sewerage and Drainage within the Llewellyn Park Section of the Township of West Orange. Joseph Riopel, 12 Ashley Road, Llewellyn Park, West Orange also commented on Ordinance #2323-11. John Bober, 31 Mountain Avenue, Llewellyn Park, West Orange also commented on Ordinance #2323-11.
2 Earl Turner, Mt. Pleasant Avenue, West Orange, inquired about the status of the Downtown Redevelopment Project. Anthony Pugliese, Public Information Officer for Essex County, updated the Council on upcoming events. There was no one else who wished to be heard and the public hearing was closed. Minutes The public Executive Session Minutes of March 8, March 29, May 3 and May 17, 2011, Special Meeting March 14, 2011 and Public Meeting of May 3, 2011 were approved as submitted. Bills The Bill List was received and ordered paid. Summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #119-11 Resolution Authorizing a Refund of 2010 Property Taxes in the Amount of $10,074.50 for Overpayment for 9 Elm Court Way, West Orange, NJ Resolution #120-11 Resolution Authorizing a Refund of 2009 Property Taxes in the Amount of $1,254.70 Resolution #121-11 Resolution Authorizing Raffle Licenses Resolution #124-11 Resolution Approving Change Order No. 3 Reducing the Automatic Door Systems, LLC Contract in the Amount of $7,500 to $107,300 and Increasing the Herbst-Musciano Contract in the Amount of $7,500 for the Completion of all Construction Contract Administrative Services Resolution #125-11
3 Resolution Authorizing a Settlement Agreement Between the Township of West Orange and West Orange Senior Citizens Housing Association in the Amount of $134,840 Resolution #126-11 Resolution Authorizing Change Order No. 1 & Final for A&J Contractor’s Group, Inc., 105 Federal Road, Monroe Township, NJ, in the Amount of $21,181.54 Resolution #127-11 Resolution Authorizing the Acquisition of Two Parcels of Undeveloped Land on Wiley Terrace for Open Space and Recreation Purposes Resolution #128-11 Resolution to Extend 2010 Contract for the Food & Beverage Concession Stand at the Ginny Duenkel Municipal Pool for 2011 to Bagelwich Bagel Bakery Resolution #129-11 Resolution to Extend 2010-2011 Auto Body Repair Contract to A. Lembo Car & Truck Collision, Inc., 76 Riverside Avenue, Newark, NJ for year 2011-2012 NTE 2011 Budget Appropriations Ordinances on Second and Final Reading Ordinance #2320-11 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, AN ORDINANCE REPEALING AND AMENDING CHAPTER 13, SECTION 3 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (CONSTRUCTION BOARD OF APPEALS), was taken up on second and final reading. Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango, Council President Anderton voting “Aye”. Councilman Cirilo was absent at the time of the voting. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed.
4 On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2321-11 On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL (This ordinance reflects a change in responsibility of the Assistant Township Attorney), was taken up second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinances on First Reading Ordinance #2322-11 On motion made by Councilwoman Spango and seconded by Councilman Cirilo, AN ORDINANCE AUTHORIZING SPECIAL EMERGENCY APPROPRIATIONS PURSUANT TO N.J.S.A. 40A:4-53 for SEVERANCE LIABILITIES RESULTING FROM ACCRUED LEAVE IN CONNECTION WITH THE RETIREMENT OF EMPLOYEES, was taken up on first reading by title only. All members voting “Aye”.
5 The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on June 14, 2011. All members voting “Aye”. Ordinance #2323-11 On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, AN ORDINANCE AUTHORIZING THE RECONSTRUCTION OF THE SYSTEM OF SEWERAGE AND DRAINAGE AND ASSOCIATED REPAIR, RECONSTRUCTION AND REPAVING OF THE ROADWAYS WITHIN THE LLEWELLYN PARK SECTION OF THE TOWNSHIP OF WEST ORANGE AS LOCAL IMPROVEMENTS TO BE ASSESSED UPON THE ABUTTING LAND PURSUANT TO N.J.S.A 40:49-6 AND N.J.S.A. 40:56-1, Et. Seq., was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. Kenneth W. Kayser, Esq., Assistant Township Attorney gave the Council a brief overview regarding the above ordinance. Deputy Director Leonard Lepore responded to questions from Council regarding the above. Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on June 14, 2011. All members voting “Aye”. Resolution #122-11 – HELD OVER Resolution #123-11 Amendment to the Municipal Budget 2011-11 Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”.
6 Resolution #96-11 Award of Bid on State Contract T-1316 with NACR, Inc., 246 Industrial West, Eatontown, NJ 07724 in the Amount of $235,881.26 for the Purchase and Installation of Telecommunications Equipment Upgrade (originally on the May 3, 2011 agenda-tabled) Following discussion and on motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #130-11 Resolution Authorizing an Executive Session to Discuss Contract Negotiations On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the Council went into Executive Session to discuss a matter of Contract Negotiations. All members voting “Aye”. The Minutes of this meeting are on file in the Office of the Municipal Clerk.
