215-10 August 17, 2010 RESOLUTION WHEREAS, pursuant to N.J.S.A. 2B:24-3, all municipalities are required to have a municipal public defender appointed by the governing body to perform the duties set forth in N.J.S.A. 2B:24-6; and WHEREAS, the Township of West Orange seeks to appoint a new municipal public defender to commence on September 1, 2010; and WHEREAS, pursuant to the Local Public Contracts Law, the Township of West Orange issued and advertised for qualifications and proposals in a fair and open process; and WHEREAS, , Esq. has submitted his qualifications to the Township of West Orange to fill the position of municipal public defender, annexed hereto; and WHEREAS, , Esq. shall exercise all his functions and perform his duties in accordance with all applicable ordinances and statutes; and WHEREAS, the compensation for the performance of the duties of the municipal public defender shall be at a rate of $350 per court session as an independent contractor; and WHEREAS, , Esq. shall provide proof of insurance naming the Township of West Orange as a third party insured with professional malpractice insurance in full force and effect in the amount of not less than $500,000 per occurrence and $1,000,000 in the aggregate; and WHEREAS, ’s appointment shall run commence on September 1, 2010 and continue until a subsequent resolution of the Township Council for the Township of West Orange; NOW, THEREFORE BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange hereby appoints , Esq. to serve as the Township’s Municipal Public Defender, beginning on September 1, 2010, in accordance with all applicable ordinances and statutes. , Esq. shall not receive any medical or other benefits related to his service as Municipal Public Defender.
