234-10 September 14, 2010 RESOLUTION WHEREAS, on August 5, 2010 a sanitary sewer backup occurred on Valley Road just east of Kingsley Street due to the collapse of several portions of the Township’s original easterly sanitary interceptor sewer installed about a century ago; and WHEREAS , due to the depth and size of the sewer main its reconstruction was beyond the capabilities of the Public Works Department; and WHEREAS , the reconstruction needed to be performed on an expedited basis to prevent sewage backups into businesses and homes on several streets in the Valley which were jeopardizing public health and welfare; and WHEREAS , the Municipal Engineer contacted the firm of Grabowski Construction, Inc. of 770 Northfield Avenue, West Orange, New Jersey to perform emergency construction; and WHEREAS, Grabowski Construction, Inc. submitted a proposal dated August 9, 2010 to perform the emergency construction for a fee of $110,320 which included police traffic director hours; and WHEREAS , this proposal was acceptable to the Municipal Engineer who authorized the work; and WHEREAS, Grabowski Construction, Inc. performed the construction to the sanitary sewer on August 9 thru August 14, 2010, and they repaired the pavement on August 16 thru August 19, 2010 for a final fee of $136,811.50; and WHEREAS, the final fee included the costs of additional Police Traffic Directors and additional costs for wet excavation and the restoration of the Columbus Island; and WHEREAS , the final cost is acceptable to the Township Engineer. NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of West Orange that an emergency appropriation in the amount of $136,811.0 is authorized to pay

Grabowski Construction, Inc. for emergency sewer construction to the Township’s sanitary sewer main on Valley Road at Kingsley Street. BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
