280-10 October 26, 2010 R E S O L U T I O N WHEREAS, in June 1993 the Township of West Orange removed three underground storage tanks at property known as Fire House No. 4 at 280 Pleasant Valley Way; and WHEREAS, during their removal, representatives of the PMK Group who prepared the closure plan found evidence that all three tanks leaked; and WHEREAS, the Remedial Investigation Report prepared by the PMK Group found soil contamination at the location of the gasoline storage tank which exceeded the New Jersey Department of Environmental Protection (NJDEP) Groundwater Soil Cleanup Criteria; and WHEREAS, the PMK Group prepared a Remedial Investigation Work plan which was approved by the NJDEP; and WHEREAS, the PMK Group implemented the requirements of the Remedial Investigation Work plan and subsequently prepared a Remedial Investigation Report dated February 6, 2008; and WHEREAS, the NJDEP letter dated June 25, 2008 and the Remedial Action Work plan Addendum approved by the NJDEP on August 6, 2008 require additional remedial investigative work consisting of vapor intrusion investigation, high vacuum extraction, groundwater sampling and regulatory reporting; and WHEREAS, the Birdsall Services (formerly PMK Group) of 65 Jackson Drive, Cranford, New Jersey submitted a proposal dated June 2, 2010 to perform these additional services to address the requirements of the NJDEP for a fee not to exceed $89,500.00.; and WHEREAS, the PMK Group responded to the Township’s open request for Professional Services in February 2010; and WHEREAS, the Township Engineer recommends Birdsall Services Group be awarded a Professional Services Contract in conformance with their proposal of June 2, 2010; and WHEREAS, the Township Council concurs in the foregoing. NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that a Professional Services Contract be awarded to Birdsall Services Group of 65 Jackson Drive, P.O. Box 5000, Cranford, New Jersey 07016 to perform the services outlined in accordance with their proposal dated June 2, 2010 in an amount not to exceed $89,500.00. BE IT FURTHER RESOLVED that whereas under the Local Public Contracts Law the services to be provided herein are of a professional nature and will not reasonably permit the drawing of specifications or receipt of competitive bids, the Township Council of the Township of West Orange

BE IT FURTHER RESOLVED that the award of these professional services to the Birdsall Services Group is made pursuant to their response to the Township’s open request for professional services of February 2010.
