281-10 October 26, 2010 R E S O L U T I O N WHEREAS, the Township Council on August 11, 2009 awarded a contract entitled “2009 Phase IV Street Improvements – Various Streets” to DLS Contracting, Inc., 633 Franklin Avenue – Suite 17, Nutley, New Jersey 07110 in the amount of $1,579,630.98; and WHEREAS, the award of this contract included the Base Bid, Alternate A, Alternate 1B, Alternate 1C, Alternate 1D and Alternate E; and WHEREAS, Alternate E was for additional work at the unit prices bid for the estimated quantity of additional work; and WHEREAS, the unit prices bid for all the Alternates were the same for the Base Bid; and WHEREAS, during the performance of this contract the contractor performed work as directed which included additional curb and sidewalk, pavement repair and pavement leveling all at the unit prices bid for the Base Bid and Alternates; and WHEREAS, to compensate the contractor for this additional work and allow the contractor to continue with the streets improvements originally specified in the bid documents at the unit prices bid an additional appropriation of $275,000 was authorized in Change Order No. 1; and WHEREAS, the Township Engineer is requesting an additional appropriation of $375,000 to place the final pavement course on Fitzrandolph Road and to mill and resurface two additional streets – Schmitt Road and Marie Terrace; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an additional appropriation of $375,000 be authorized as Change Order No. 3 for the contract 2009 Phase IV Street Improvements – Various Streets” with DLS Contracting, Inc. of 633 Franklin Avenue, Nutley, New jersey to continue work in accordance with that
