343-10 December 14, 2010 RESOLUTION OF THE TOWNSHIP OF WEST ORANGE, COUNTY OF ESSEX, NEW JERSEY REFERRING PROPOSED THIRD AMENDMENT TO THE DOWNTOWN REDEVELOPMENT PLAN TO THE TOWNSHIP PLANNING BOARD FOR ITS REVIEW AND COMMENT PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW WHEREAS, the Township Council of the Township of West Orange (the “Township Council”) heretofore duly adopted a Resolution determining that an area within the West Orange downtown area (the “Downtown Redevelopment Area”) was an “area in need of redevelopment” in accordance with N.J.S.A. 40A:12A-6(b); and WHEREAS, in accordance with the provisions of N.J.S.A. 40A:12A-7 the Township Council on February 9, 2003 approved an ordinance adopting a redevelopment plan for the Downtown Redevelopment Area (the “Initial Redevelopment Plan”); and WHEREAS, on August 15, 2006, the Township Council approved an ordinance adopting certain amendments (the “First Amendment”) to the Initial Redevelopment Plan (as so amended, the “First Amended Redevelopment Plan”); and WHEREAS, on March 6, 2007, the Township Council approved an ordinance adopting certain further amendments (the “Second Amendment”) to the First Amended Redevelopment Plan (as so amended, the “Redevelopment Plan”); and WHEREAS, the Township is contemplating modifying the “Home Services District” within the Redevelopment Plan to add bus parking as a permitted use, and to establish bulk standards relating to such use; and WHEREAS, a proposed amendment to the Redevelopment Plan to this effect, dated December 2010, is attached hereto as Exhibit A and by this reference incorporated herein (the “ Proposed Third Amendment”); and WHEREAS, in accordance with the provisions of N.J.S.A. 40A:12A-7 the Township wishes to utilize the Planning Board's experience and expertise in evaluating the Proposed Third Amendment and determining, among other things, their consistency with the Township's land use and redevelopment goals and objectives for the Downtown Redevelopment Area, NOW THEREFORE, BE IT RESOLVED by the West Orange Township Council: I. GENERAL The aforementioned recitals are incorporated herein as though fully set forth at length.
II. PLANNING BOARD DIRECTED TO PREPARE REPORT The Township Council hereby authorizes and directs the Planning Board to review the Proposed Third Amendment, and, as provided by N.J.S.A. 40A:12A-7, to transmit a report containing its recommendations to the Township Council within forty-five (45) days. III. SEVERABILITY If any part of this Resolution shall be deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the remaining parts of this Resolution. IV. AVAILABILITY OF THE RESOLUTION A copy of this resolution shall be available for public inspection at the offices of the Township. V.
