ZONING BOARD AFFIDAVIT OF PROOF OF PUBLICATION AND MAILING STATE OF NEW JERSEY COUNTY OF ESSEX Erica A. Parlavecchio, Attorney for Applicant, of full age, being duly sworn according to law, deposes and says that she works at Chiesa Shahinian & Giantomasi, PC, 105 Eisenhower Parkway, in the Municipality of Roseland, and the State of New Jersey, and that she is the attorney for the applicant in a proceeding before the Zoning Board of the Township West Orange, Essex County, New Jersey, relating to premises located at 325 Mount Pleasant Avenue and designated on the Township of West Orange Tax Map as Block 155, Lot 26.01. The Applicant proposes to demolish small, existing one (1) story buildings on the Property and to install a new one (1) story 26kV switchgear enclosure to house the addition of a 26kV switchgear and feeder reactors. Additionally, the Applicant proposes new drive paths to be located in the southeast corner of the station yard. The Applicant also proposes to remove the existing perimeter fence and replace it with a new eight (8) foot tall fence along Mount Pleasant Avenue (State Highway Route 10) and Prospect Avenue (County Route 577). Finally, the Applicant proposes install a series of small-scale bioretention basins to the east of the new equipment and to construct six (6) 70-foot tall lightning masts to protect the new equipment from lightning strikes. The Applicant is proposing to utilize temporary construction trailers on the Property for the duration of the installation of the improvements discussed above. Section 25-7.1, Attachment 2, Table of District Regulations, Part A: Permitted Uses Table of District Regulations of The Land Use Regulations of the Township of West Orange (the “Land Use Regulations”) does not list “Public Utility Buildings or Structures” as a permitted use. As discussed above, the Applicant is proposing new equipment in the Station and a number of other improvements. As a result, the Applicant seeks variance relief pursuant to N.J.S.A. 40:55D-70.d.(2) to allow for the expansion of such nonconforming use. Section 25-7.1, Attachment 3, Table of District Regulations, Part B: Bulk Standards of the Land Use Regulations provides that the maximum permitted height is 2.5 stories and not exceeding 35 feet. The Applicant proposes to install six (6) 70-foot lightning masts, when measured to the adjacent finished grade, and

As a result, the Applicant seeks variance relief pursuant to N.J.S.A.40:55D-70.d.(6). The Applicant also seeks the following additional bulk variance relief from Section 25-7.1, Attachment 3, Table of District Regulations, Part B: Bulk Standards pertaining to the O-R Zone: (1) a variance from the requirement that the front yard and side yard setback of corner lots must be a minimum of 100 feet, whereas the Applicant proposes front yard setback 4890-1368-9301.v1

along Mount Pleasant Avenue (State Highway Route 10) to be 77.9 feet and (2) a variance from the requirement that the maximum permitted lot coverage is 30%, whereas the Applicant proposes the lot coverage to be 49%. Additionally, the Applicant seeks a variance from Section 25-8.4.d. of the Land Use Regulations, which provides that fences or walls to be used for screening in nonresidential districts may not exceed six feet in height. The Applicant proposes perimeter fencing that is eight (8) feet in height. The Applicant seeks to continue the following pre-existing nonconformity on the Property, or in the alternative, seeks variance relief, to the extent relief for such continuation is required: (1) to permit a space between buildings of 20.76 feet, whereas 150 feet is required. Notice was given of this proceeding to each and all of the owners of property affected by said application, in the required form, in the manner provided by law (via Certified Mail, return receipt requested) on August 1, 2024. A copy of the notice that was sent to all property owners is attached hereto as Exhibit “A”. A copy of the 200° lists obtained from the Township of West Orange Tax Assessor is attached hereto as Exhibit “B”. Copies of the Certified Mailing receipts are attached hereto as Exhibit “C”. A copy of the notice published in the Star Ledger on August 5, 2024 is attached hereto as Exhibit “D”. LEGAL NOTICE TOWNSHIP OF WEST ORANGE ZONING BOARD OF ADJUSTMENT PLEASE TAKE NOTICE that on August 15, 2024 at 8:00 P.M., a remote public hearing will be conducted before the Township of West Orange Zoning Board of Adjustment (the “Zoning Board” or “Board”) for a preliminary and final major site plan application with variance relief filed by Public Service Electric & Gas Company (the “Applicant”), in connection with property located at 325 Mount Pleasant Avenue and designated as Block 155, Lot 26.01 on the Tax Map of the Township of West Orange, New Jersey (the “Tax Map”) (the “Property”’). The Property is located within the O-R Office Research District (the “O-R Zone”), the Planned Unit Residential Development (PURD) Zone (the “PURD Zone”) and the R-5 Single Family Residential Zone (the “R-5 Zone”). The station yard and a portion of the transmission ROW are located within the O-R Zone. The Property is presently developed with the West Orange Switching Station (the “Station”), which is operated by the Applicant. The Station contains specialized electrical equipment and is currently used as a public utility installation-electric substation. The Station consists of several buildings: a multi-story brick building, a one-story control house and two (2) single-story buildings. The Station has been in operation for almost one hundred (100) years and will remain a public utility following completion of the proposed improvements.
