Accordingly, attached are the following documents, which are relevant to the portions of Oval Road (a) in West Orange between Warner Road and the West Orange/Essex Fells border and (b) in Essex Fells between the West Orange/Essex Fells border and Holton Lane: 1. Resolution adopted by the West Orange Planning Board on November 7, 1984, approving an application of West Essex Developers, Inc., subject to certain conditions, including several relating to Oval Road; 2. Agreement among West Orange, Essex Fells, West Essex Developers, Inc. and the Essex Fells Country Club, executed in March and April, 1987, relating to the vacating of portions of Oval Road by West Orange and Essex Fells; 3. Essex Fells Ordinance, adopted August 18, 1987, vacating the portion of Oval Road in Essex Fells from Holton Lane to the Essex Fells/West Orange border; and 4. March 9, 2006 letter from the Essex Fells Borough Administrator to the West Orange Township Business Administrator, reminding West Orange - in connection with a different development application in the West Essex Highlands -- that these sections of Oval Road are permanently closed to the public. As discussed during the September 17, 2025 hearing, the vacation of the roadway by West Orange and Essex Fells does contain an exception for emergency vehicles responding in Essex Fells or West Orange, meaning police and firefighting vehicles and ambulances.
