2535-18 AN ORDINANCE AMENDING CHAPTER 18, SECTIONS 1.7, 1.8 AND 1.8 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (LOCAL ENFORCEMENT OF THE UNIFORM FIRE CODE) BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that Chapter 18 of the Revised General Ordinances of the Township of West Orange be and are hereby amended as follows: I. PURPOSE The purpose of this Ordinance is to update the Municipal Code provisions related to the enforcement of the uniform fire code consistent with recommendations provided the State of New Jersey, Department of Community Affairs, Division of Fire Safety after its most recent audit of the Fire Prevention Bureau of the West Orange Fire Department. II. CHAPTER 18, SECTION 1.7 SHALL BE AND HEREBY IS AMENDED AND SUPPLEMENTED TO INCORPORATE THE FOLLOWING: 18-1.7 Board of Appeals. Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, N.J.S.A. 52:27-206 and 208, respectively, any person aggrieved by any ruling, action, order, or notice of the Local Enforcement Agency (or agencies) shall have the right to appeal to the Essex County Construction Board of Appeals. III. CHAPTER 18, SECTION 1.8 SHALL BE AND HEREBY IS AMENDED AND SUPPLEMENTED TO INCORPORATE THE FOLLOWING: 18-1.8 Additional Required Inspections and fees. In addition to the inspection and fees required pursuant to the Act and the regulations of the Department of Community Affairs, the following additional inspections and fees shall be required, including life hazard uses and life hazard uses at a minimum of bi-annually. IV. CHAPTER 18, SECTION 1.9 SHALL BE AND HEREBY IS AMENDED AND SUPPLEMENTED TO INCORPORATE THE FOLLOWING: 18-1.9 Permits The permit fees established by the Uniform Fire Code shall be amended to be as follows: Type 1 $ 54.00 (To also include the use of cooking equipment in a commercial establishment of less than fifty (50) people). Type 2 $ 214.00 Type 3 $ 427.00

2 Type 4 $ 641.00 V. REPEAL OF CONFLICTING ORDINANCES Any Ordinances of the Township which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. VI. SEVERABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance. VII. EFFECTIVE DATE This Ordinance shall take effect upon final passage and publication in accordance with the law. Freeholders. ________________________________________ ROBERT D.
