27-18 January 9, 2018 RESOLUTION WHEREAS, Daughters of Israel Geriatric Services, Inc. (“Daughters” is the current owner of certain property known as 748-750 Northfield Avenue in the Township of West Orange, Essex County, New Jersey commonly known as the Jewish Federation Plaza (the “Property”); WHEREAS, the Property is shown on the Tax Map of the Township as Block 165, Lot 16; and WHEREAS, under the current plan for refinancing and improvements, Daughters will convey the Property to JFP Housing LLC (“JFP”); and WHEREAS, by Resolution adopted May 23, 2017, No. 108-17 adopted by the Township Council of the Township of West Orange, the Council approved an agreement with JFP for payments in lieu of taxes (“PILOT”); and WHEREAS, Daughters has contacted the Township and indicated that the Resolution contains certain typographical errors including the number of affordable units which should be 134 as opposed to 135 and that the Tax Map description should be Lot 16, instead of Lots 15, 18, 19; and WHEREAS, the New Jersey HMFA legal counsel has requested a Resolution clarifying these items; and WHEREAS, the within resolution is consistent and purely amends Resolution Number 108-17.
NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNSEL OF THE TOWNSHIP OF WEST ORANGE THAT RESOLUTION NUMBER 108-17 IS HEREBY AMENDED AS FOLLOWS; 1. The number of affordable units is 134 instead of 135 and the Property is hereby amended to reflect Lot 16 instead of Lot 15, 18 and 19; and 2. Resolved that all other aspects of Resolution 108-17 be and are hereby ratified in its entirety.
