70-18 February 8, 2018 RESOLUTION WHEREAS, Wayne DeFeo (“DeFeo”) responded to the Township’s Request for Qualifications pursuant to a fair and open process for the award of a professional services agreement for Environmental Consultant Services for the year 2018; and WHEREAS, DeFeo has agreed to serve as environmental compliance officer for the calendar year 2018, pursuant to the terms and conditions set forth in the agreement annexed hereto as Exhibit “A;” and WHEREAS, on January 23, 2018, the Council voted 3-2 against the attached agreement; and WHEREAS, following the January 23, 3018 meeting, two (2) of the “no” votes indicated they seek to reconsider their votes; and NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute an agreement, in the form annexed hereto, to retain DeFeo as environmental compliance officer for the Township on the terms and conditions set forth therein; and it is further RESOLVED that notice of this award shall be available in the Clerk’s office in accordance with applicable law.
