85 - 18 February 27, 2018 RESOLUTION AUTHORIZING JOINT BID FOR SOLID WASTE DISPOSAL AND SINGLE STREAM RECYCLING SERVICES WITH WEST ORANGE SCHOOL DISTRICT WHEREAS, the West Orange Solid Waste Advisory Committee (“WOSWAC”) recently met with the West Orange Superintendent of Schools and representatives of the West Orange Board of Education and School District to explore the feasibility of engaging in a joint bid process for solid waste disposal and single stream recycling services for both the Township of West Orange and the West Orange School District; and WHEREAS, the Township’s current contract expires in early September, 2018, and the School District’s contract expires in October, 2018; and WHEREAS, the Township and the School District have the ability pursuant to N.J.S.A. 40:8A-1, et seq., to enter into a Shared Services Agreement, also known as an Interlocal Services Agreement, with each other as separate local government entities; and WHEREAS, in view of the current contract expirations for both entities occurring in close proximity to each other and the possibility of savings for either or both through a joint bidding process, the WOSWAC and the School District have agreed to participate in such a joint bidding process to better determine the possible savings and convenience of then entering into an Interlocal Services Agreement between the entities for solid waste disposal and single stream recycling services; and WHEREAS, the WOSWAC is currently engaged in preparation of the bid specifications which will include in one or more options combining these services in such a fashion that both parties can then evaluate the benefits and detriments, if any, to entering into a Shared Local Services Agreement for such services and to determine whether or not such an Agreement will be in their best interests; and WHEREAS, at its Regular/Work session on February 12, 2018, the Board of Education of the West Orange School District voted unanimously to approve to bid solid waste disposal and single stream recycling services jointly with the Township of West Orange, the Township to be the lead agency, an extract from the minutes of that meeting attached hereto and made a part hereof; and WHEREAS, the Board of Education and the Township of West Orange reserve all of their rights with respect to the acceptance and rejection of bids under the Local Public Contract Law

a part hereof; and WHEREAS, the Board of Education and the Township of West Orange reserve all of their rights with respect to the acceptance and rejection of bids under the Local Public Contract Law and any and all statutes and regulations governing their respective entities, and will make final determinations about whether or not to enter into an Interlocal Services Agreement for solid waste disposal and single stream recycling services after the bids have been received and analyzed;

NOW, THEREFORE, BE IT AND IT HEREBY IS RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Township’s Business Administrator and the West Orange Solid Waste Advisory Committee are authorized, with the Township of West Orange as the lead agency, to prepare bid specifications and to publicly advertise a bid to include in one or more options for the provision of solid waste disposal and single stream recycling services jointly with the West Orange School District pursuant to a Shared or Interlocal Services Agreement to be entered into by those respective local government entities at or about the time of acceptance of the bid. ____________________________________ __________________________________ Karen J.
