119-18 May 8, 2018 R E S O L U T I O N WHEREAS, Auto Zone Northeast, LLC, 123 South Front Street, 3rd Floor, Memphis, Tennessee 38103 is the developer of an Auto Zone at 7 Main Street, Block 60, Lots 1.01 & 2.01; and WHEREAS, Auto Zone Northeast, LLC was required by its site plan approval of the West Orange Planning Board dated March 4, 2015 to post a restoration Performance Bond in the amount of $37,251.72 to guarantee the restoration of this property in the event the property was not developed pursuant to the Planning Board approval; and WHEREAS, Auto Zone Northeast completed the building and associated site improvements, was issued a Certificate of Occupancy and opened the Auto Zone store in September 2016; and WHEREAS, by letter dated April 10, 2018 Auto Zone Northeast, LLC requested their restoration Performance Bond be released pursuant to N.J.S.A. 40:55D-53d; and WHEREAS, the Municipal Engineer advised the Township Council by letter dated April 30, 2018 that the restoration Performance Bond may be released; and WHEREAS, the Township Council concurs in the foregoing. NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that the restoration Performance Bond posted by Auto Zone Northeast, LLC, 123 South Front Street, 3rd Floor, Memphis, Tennessee 38103 associated with the development of an Auto Zone store at 7 Main Street, Block 60, Lots 1.01 & 2.01 be released. BE IT FUTHER RESOLVED that a certified copy of the Resolution be sent by Certified Mail to Auto Zone Northeast, LLC. _________________________________ __________________________________ Karen J.
