145-18 June 12, 2018 RESOLUTION WHEREAS, on January 9, 2018, the Township of West Orange (the “Township”) adopted Resolution 17-18 designating certain real property located on Executive Drive and Rooney Circle and more commonly known as Block 155, Lots 40.02, 40.03, 41.02, 42.01, and 42.02 and Block 155.21, Lot 40 on the Township of West Orange Tax Map (the “Redevelopment Area”) as a Non-Condemnation Area in Need of Redevelopment; and WHEREAS, N.J.S.A. 40A:12A-7 of the Local Redevelopment and Housing Law requires a Redevelopment Plan to be prepared and referred to the Planning Board for its review and recommendation in accordance with N.J.S.A. 40A:12A-7(e); and WHEREAS, Phillips Preiss Grygiel, LLC (“PPG”) was previously directed to prepare a Redevelopment Plan, but that the Planning Board has requested that a separate planner be retained to prepare the Redevelopment Plan; and WHEREAS, Heyer, Gruel & Associates located at 236 Broad Street in Red Bank, New Jersey 07701 (“Heyer, Gruel”) submitted a proposal, annexed hereto as Exhibit “A” (the “Proposal”) to prepare and present a Redevelopment Plan for the Redevelopment Area for an amount not to exceed $35,000. NOW THEREFORE, BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Township be and hereby is authorized to retain Heyer, Gruel to prepare a Redevelopment Plan consistent with the requirements of N.J.S.A. 40A:12A-7 and the Proposal annexed hereto as Exhibit “A;” and be it further RESOLVED, that the Business Administrator is authorized to execute any necessary agreements or documents, if any, to finalize the retention of Heyer, Gruel consistent with the Proposals annexed hereto as Exhibit “A;” and be it further

2 RESOLVED, that the Municipal Clerk be and is hereby authorized to attest to the Business Administrator’s signature; and be it further RESOLVED, that a copy of this Resolution shall be made available in the Clerk’s office in accordance with applicable law.
