179-18 July 17, 2018 RESOLUTION WHEREAS, the Township of West Orange prepared Bid Specifications for Township Refuse and Recycling Collection Service and Solid Waste and Recycling Collection and Disposal Service for West Orange Public Schools and Facilities; and WHEREAS, the Township’s Refuse and Recycling Collection service contract is scheduled to expire on September 9, 2018 and the Public Schools Solid Waste Collection service is scheduled to end on October 31, 2018; and WHEREAS, on March 29, 2018 public notice of a new contract for the Township and the Public Schools was given by publication and other means; and WHEREAS, the Solid Waste Advisory Committee reviewed the bid specifications and has supervised the procedure in cooperation with the Purchasing Agent; and WHEREAS, on May 31, 2018 certain bids were opened in the Township Municipal Building; and WHEREAS, Suburban Disposal, Inc. submitted the only bid for Township services and was determined by the West Orange Township Council to be a responsible bidder; and WHEREAS, Interstate Waste Services of New Jersey, Inc. was determined to be the lowest responsible bidder for West Orange Public Schools services: and WHEREAS, No company bid on both Township and Public Schools Services together; and WHEREAS, the Assistant Township Attorney has provided various advice concerning the legal issues involved herein; and WHEREAS, the Mayor has recused himself from participating in this contractual matter due to a potential conflict of interest with the responsible bidder, having designated the Business Administrator as the Acting Mayor for purposes of engaging in this bidding process and in executing this contract; and

WHEREAS, the Solid Waste Advisory Committee recommends awarding the contract for Township Refuse and Recycling Collection Services to Suburban Disposal, Inc. for a period of five years for the following Options: OPTION #1 Item #1 – Refuse Collection Service for residential sources two times per week in three zones. Item#2 – Additional Refuse Collection Services; municipal sources, limited commercial collection two times per week in three zones, bulky trash collection for residential sources one time per week in three zones, litter basket collection two times per week in three zones and four times per week in designated zones, refrigerants and electronic waste one time per week on a call in basis to the contractor. Item#3 – Recycling Collection Service to residents, municipal sources and limited commercial collection one time per week in three zones utilizing a single stream method. OPTION #4 – RENTAL OF COMPACTOR TRUCK The Contractor shall be required to rent one or more 31 cubic yard compactor trucks, with driver, to assist the Township with leaf collection, or at such other times the Township may direct. OPTION #5 – REFUSE CONTAINER MECHANICAL PICK UP The Contractor shall provide two or more refuse containers for use by the Township to be placed at designated Municipal Sources. The containers shall be 20, 25, 30 or 40 cubic yards and the placement; hauling and tipping fees shall be included in the bid price. This does not include disposal fees. WHEREAS, the Board of Education recommends awarding the contract for Solid Waste and Recycling Collection Services to Public Schools to Interstate Waste Services of New Jersey, Inc. for a period of five years for the following Option; OPTION #6 WEST ORANGE PUBLIC SCHOOLS AND SCHOOL FACILITES SOLID WASTE AND RECYCLING COLLECTION AND DISPOSAL BE IT NOW HEREBY RESOLVED by the Township Council of the Township of West Orange that the Township Refuse and Recycling Collection Contract effective September 10, 2018 for OPTION #1 – ITEMS #1, #2 AND #3, OPTION #4 and OPTION

#5; and hereby be awarded to Suburban Disposal, Inc. for a period of (5) five years; and OPTION #6 West Orange Public Schools and School Facilities Solid Waste and Recycling Collection and Disposal Contract effective November 1, 2018; and hereby be awarded to Interstate Waste Services of New Jersey, Inc. for a period of (5) five years. NOW, BE IT HEREBY RESOLVED, that the Business Administrator and Municipal Clerk are hereby authorized to execute and attest to the execution of all appropriate documents to effectuate the award of this bid as contained herein; and it is further RESOLVED, that the Municipal Clerk is hereby directed to cause notice of this award to be published in accordance with applicable law and shall maintain a copy of the Contract on file for public inspection.
