2548-18 AN ORDINANCE SUPPLEMENTING CHAPTER 5, ADDING SECTION 8.8 AND CHAPTER 18, ADDING SECTION 18.10 TO THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (Exception) BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that Chapters 5 and 18 of the Revised General Ordinances of the Township of West Orange be and are hereby amended and supplemented as follows: I. PURPOSE The purpose of this ordinance is to allow the Township to exempt the licensing fees imposed by the Health Department and inspection fees imposed by the Fire Department for Mobile Retail Food Establishments when those establishments are participating in events sponsored by the Township of West Orange. II. CHAPTER 5, SECTION 8.8 SHALL BE AND HEREBY IS ADDED TO INCORPORATE THE FOLLOWING: 5-8.8 Exception. Exception. The license fee may be waived for Mobile Retail Food Establishments operating on an itinerant basis at an event sponsored by the Township of West Orange, provided that a license and inspection is still required prior to the event. III. CHAPTER 18, SECTION 1.10 SHALL BE AND HEREBY IS ADDED TO INCORPORATE THE FOLLOWING: 18-1.10 Exception. The inspection fee required under the New Jersey Fire Code may be waived for Mobile Retail Food Establishments operating on an itinerant basis at an event sponsored by the Township of West Orange, provided that an inspection is still required prior to the event. IV. REPEAL OF CONFLICTING ORDINANCES Any Ordinances of the Township which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. V. SEVERABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance.
