192-18 September 4, 2018 RESOLUTION WHEREAS, on March 7, 2017, the Township Council adopted Resolution No. 74-17 which authorized the Mayor to execute an Interim Redevelopment Agreement with The Alpert Group, LLC (“Alpert”); and WHEREAS, on March 7, 2017, the Township and Alpert executed the Interim Redevelopment Agreement; and WHEREAS, the Interim Redevelopment Agreement remains in full force and effect; and WHEREAS, part of the designated areas includes Lot 32, Block 9 on the Tax Map of the Township of West Orange which is also known as the Biddleman Parcel (the “Property”); and WHEREAS Alpert has entered into a Contract to acquire the Property; and WHEREAS the Property is part of the Brownfields Development area “BDA” which provides a source of funds for the investigation and the remediation of certain environmental issues; and WHEREAS, the Property is directly contiguous to the Selecto Flash Property which the Township currently owns and which Parcel is also part of the redevelopment area; and WHEREAS, the Township desires to support the redevelopment area by acquiring the Property for a potential public use such as parking or other complementary uses to the residential and commercial neighborhood; and WHEREAS, the Township and Alpert have negotiated the First Amendment to Interim Redevelopment Agreement which was annexed hereto as Exhibit “A”; and
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute the annexed First Amendment to Interim Redevelopment Agreement between the Township of West Orange and The Alpert Group, LLC; IT FURTHER RESOLVED that notice of the approval and execution of this Agreement shall be made in accordance with law and a copy of the First Amendment shall be maintained by the Municipal Clerk for the Township of West Orange. Approval of this Resolution is acceptable to the Law Department based upon the facts and circumstances provided. Karen J. Carnevale, R.M.C.
