1 193-18 September 4, 2018 RESOLUTION WHEREAS, Valley Road Residential Urban Renewal, LLC (“Valley Road Residential”) owns certain Property in the Township of West Orange (“Township”) located at 22 Central Avenue known as Block 9, Lots 1, 7, 44, 50 and 56 which consists of approximately 1.5 acres; and WHEREAS, the tax map for the property now known as Block 9, Lot 1.01 has a sketch of a storm water division structure marked as a Storm Easement; and WHEREAS, the storm water drainage channel that runs along the east side of the property has been fully upgraded in accordance with approvals and permits granted by all applicable government agencies; and WHEREAS, the storm water diversion structure has been abandoned and removed; and WHEREAS, the Township engineer has confirmed the storm water division structure has been abandoned; and WHEREAS, the Township now seeks to abandon, terminate and release any easement that previously may have existed by reason of the sketch on its tax maps and that the tax map be updated and revised to remove any such sketch on the property now known as Tax Map Block 9, Lot 1.01 by entering into the Release of Storm Easement annexed hereto as Exhibit “A;” NOW, BEING HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Release of Storm Easement be and is hereby approved and Valley Road Residential shall have the right to have the Release of Storm Easement recorded in the public land records; and it is further

2 RESOLVED, that the Mayor be and is hereby authorized to execute the Release of Storm Easement and the Municipal Clerk is hereby authorized to attest to the Mayor’s signature; and it is further RESOLVED, that a copy of this Resolution shall be made available in the Clerk’s office in accordance with applicable law. _____________________________ ______________________________ Karen Carnevale, R.M.C.
